The purpose of our letter is to request that the following listed improvements be
approved and accepted as being constructed under City inspection and completed
according to plans and specifications as approved and required by the City of College
Station, Texas. This approval and acceptance by the City is requested in order that we
may finalize any subcontracts and to affirm their warranty on the work. This approval
and acceptance by the City of the improvements listed below does hereby void the letter
of guarantee for the listed improvements on the above referenced project.

best judgment at this time for public improvements only. Private infrastructure costs (i.e. phone, CATV, Electrical, etc.) are not
included in this estimate and should be determined obtained by the developer/owner. Please note that the engineer does not have
any control over contractor or supplier workloads and the degree to which inflation may affect project costs between now and
the bid date. During construction, additional features may become apparent as the work progresses, which may result in an
increase or decrease in the project cost.

The Texas Department of Transportation, hereinafter called the State, hereby authorizes
hereinafter called the Permittee, to ® construct / ❑ reconstruct a residential street (residential, convenience
store, retail mall, farm, etc.) access driveway on the highway right of way abutting highway number S.H.40 in Brazos
County, located approximately 990 feet south of the intersection of S.H. 40_South Bound & Barron Road in College Station
Subject to the Access Driveway Policy described on page 2 and the following:
1. The undersigned hereby agrees to comply with the terms and conditions set forth in this permit for construction and maintenence
of an access driveway on the state highway right of way.

All construction of materials shell be subject to fnspeclion and approval by the State.
3. Maintenance of facilities constructed hereunder shall be the responsibility of the Permiltee, and the State reserves the right to
require any changes, maintenance or repairs as may be necessary to provide protection of life or property on or adjacent to the
highway. Changes in design will be made only with approval of the Slate.
4. The Permittee shall hold harmless the State and Its duly appointed agents and employees against any action for personal injury or
property damage sustained by reason of the exercise of this permit.
5. Except for regulatory and guide signs at county roads and city streets, the Permittee shall not erect any sign on or extending over
any portion of the highway right of way, and vehicle service fixtures such as fuel pumps, vendor stands, or tanks and shall be
located at least 12 feet from the right of way line to ensure that any vehicle services from these fixtures will be off the highway right
of way.
6. The Slate reserves the right to require a new access driveway permit in the event of a material change in land use or change in
driveway traffic volume or vehicle types.
7. This permit will become null and void if the above -referenced driveway facilities are not constructed within six (6) months from the
issuance date of this permit.
8. The Permittee will contact the State's representative
telephone, (_) , at least twenty-four (24) hours prior to beginning the work authorized by this permit.
9. The requesting Permittee will be provided Instructions on the appeal process if this permit request is denied by the State.

Title 43 Texas Administrative Code (Transportation), Chapter I I (Design), Subchapter C (Access Connections To State Highways) and the
"Access Management Manual" establish policy for the granting of access and the design, materials, and construction of driveways connecting to
state hiehways. All drivewav facilities must follow this oolicv.

GENERAL SPECIAL PROVISIONS (Access Driveway Permit):
1) Traffic Control plan is required per TMUTCD prior to start of construction in the SH40 right-of-
ways.
2) Areas within ROW disturbed by construction shall be restored to equal or better
conditions than existing prior to construction, contractor is responsible for repairing
damage to existing ROW front and backslope e.g. re-establishing vegetation and fill-in
ruts
3) Contractor shall be responsible for locating all utilities within the right-of-way construction site.
Contacts with local utility companies and utility locators are required.
4) Any lane closure will be allowed only between 8:30 AM and 4:30 PM,
5) No undercutting of existing asphalt pavement will be allowed. Existing pavement on SH40 @
the entrance site shall be removed by neat cutting as indicated.
6) Driveway shall be constructed as per Plan Details & Specifications (See attached). Driveway
radius shall be 40'. Pavement shall be Non -trackable.
7) SETs (6:1) shall be required for ends of access driveway pipe (See attached).
8) Ditch Sections upstream and downstream at proposed access driveway shall be graded
to drain.
9) Pavement surfaces shall be kept clear of mud, debris. etc.
10) Contractor shall notify Jeffrey Holland Brazos Maintenance (979-778-8054) for handling of any
roadway signs in conflict with access driveway.
11) All signs installed by the Contractor in the ROW shall have breakaway bases as per TxDOT
Standard Details
12) Erosion controls shall be installed as required.
13) Contractor shall contact Jeffrey Holland at 979-778-8054 or Jeff rey.Holland@TxDOT.gov.
48 hours prior to starting work.
1) Contractor is responsible for repairing damage to existing ROW front & Back slope (e.g.
re-establishing vegetation and fill-in ruts).
2) Pavement Structure for the Deceleration lane should be per plans.
a. 8" CRCP (Continuously Reinforced Concrete Pavement) Reinforced per TXDOT
Standards attached.
b. 8" Lime / Cement Stabilized Subgrade
3) Removal of existing and installation of new pavement markings shall comply with TxDOT
Specifications.
