On February 9, 2012, the Board of Regents of The Texas A &M University System authorized the Chancellor, or Designee, to negotiate and execute a Ground Lease Agreement with American Campus Communities, Inc. ( "ACC "), for the construction, maintenance and operation of a campus housing facility. In order to facilitate construction, ACC has requested that the City of College Station abandon right -of -ways for Milam Street and a portion of Culpepper Street and a 0.55 acre public utility easement. TAMUS System Policy 41.01 grants the Chancellor of TAMUS the authority to: "...execute and deliver on behalf of the Board, all contracts, agreements, closing documents, deeds, assignment, leases, easement, permits, license, listing agreement, division order and all other documents necessary to carry out the powers granted to the Chancellor by this policy, and to perform other specific real property transactions authorized by the Board."
