Enclosed under cover of this letter are five (5) originals of the Preliminary Site Plan dated
January 15, 2004, of our proposed retail center to be constructed at 819 Texas Avenue, College
Station, Texas, for your review. The enclosed preliminary site plan is being submitted to you for
review prior to January 21, 2004, and it is our understanding that we are scheduled for a pre -
development meeting with the City of College Station on Monday, January 26, 2004, at 4:00 p.m.

1 called and left a message for Mr. Lopez to call me back on the sidewalks and dumpster location.
Pete Caler came by my office today and said that the dumpster location will not work. Access to
dumpsters are required to meet fire lane standards now, Pete suggested a 90- gallon can to be rolled out
to the ROW on trash days (this is currently what's being used out there). This may actually free up a
parking space or provide more room for the required end islands that are not being met.
Also, side walks are going to be required at Lincoln Ave and Texas (to meet the width of existing
sidewalks at Lincoln and Texas).
I will try calling him back again tomorrow morning if I do not hear from him by 5:00 today.

Dear Sir and Madame:
In connection with the above - referenced matter, the purpose of this letter is to provide the
Development Services Committee of the City of College Station with a written description of the
building materials of the Center which will be visible from the public streets (Texas Avenue and
Lincoln Drive) and right -of -ways.
Accordingly, the following building materials will be used in the Center and will be visible
from Texas Avenue and/Lincoln Drive:
1. E.I.F.S. (Exterior Insulating Foam System);
2. Clear andodized store front window system with clear glazing;
3. 8" x 16" x 4" - "Split- face" concrete masonry unit; and
4. Canvas awning over a black frame.

Re: Access Drive Variance Request - Proposed retail center to be constructed at 819
Texas Avenue, College Station, Texas (the "Center ")
Dear Sir and Madame:
In connection with the above - referenced matter, the purpose of this letter is to request a
variance from the City of College Station with regard to the proposed access drive ( "Access Drive ")
to be constructed to and from the Center off of Lincoln Drive. I have take the liberty of attaching
a copy of the site plan for the Center (showing the cross - hatched Access Drive) for your review.
As you may know, the location of the Access Drive is closer in proximity to Texas Avenue
than what is required and permitted under the applicable ordinances of the City of College Station.
It is our understanding that at the pre- development meetings with the Development Services
Committee, representatives of Ponderosa Land Development Company informed the members of
the Development Services Committee of the location of the Access Drive and that the Development
Services Committee was favorable in granting a variance with respect to such location of the Access
Drive.
Accordingly, we hereby request a variance from the City of College Station with regard to
the location of the Access Drive to permit us to construct, locate, and operate the Access Drive as
shown on the attached site plan.

TxDOT has the following comments:
1. Lincoln Retail Center - Access shown to be off of Lincoln, not
Texas Avenue. Great with us.
2. Koppe Bridge II - I only received C1.1. Therefore, I am unable to
tell what is existing and what is proposed. They will not be permitted
a 2nd drive if it isn't already existing.
3. Okay. When drive is permitted, we will want to ensure that the
property owner to north is okay with the slight encroachment of the
driveway radius in front of their frontage. We also would like to see a
"Do Not Enter" sign on their property showing that they can't leave the
business on the Texas Avenue Drive.

Mark -
It appears that there is nothing in our ordinances that would require the developer of this site to remove the
pavement in the TxDOT ROW. Besides, there are drainage facilities, electric facilities, etc. in that area that need
to be addressed. We can require that they close the existing driveway /access and construct a 6' sidewalk along
Texas Avenue. (You mentioned that the City has a maintenance agreement with TxDOT, but I don't see how
we can require the developer to perform that work.)
As far as the sidewalks go; We can require a 6 -foot back of curb sidewalk, but as we discussed yesterday,
the sidewalks along Texas Avenue are 8 or 10 feet with decorative pavers. Are we able to commit funds to pay
for the difference? If not, I will go ahead and just require the 6 foot sidewalks.

To whom this may concern,
In regard to the referenced project, the following are the responses to the comments made
by the City of College Station dated July 16, 2004 as requested by the city.
PLANNING and ENGINEERING:
1. PLANNING - Have corrected the site plan to reflect the required parking on both
the AS & L1.0 sheet. Also the sidewalks have been revised as requested and sod
has been noted to be placed between the curb and the sidewalk on Lincoln Ave.
and Texas Ave. The area that is presently paved will remain (in the TXDQT right-
of-way) and is noted. (Revision #5)
2. ENGINEERING - In regard to the curbs along Texas Ave. the curb now stops at
the proposed handicap ramp at the NW side of the property. A new curb is noted
to be placed along the property line parallel to Texas Ave. within the property to
retain the sod. The proposed sidewalk will be placed along Texas Ave. as
requested on Sheets AS & L1.0. (Revision #5)
This responds to the comments made by the City of College Station to the referenced

We have discussed the sidewalk issues for this Site previously. I plan on having them do no work in the
TxDOT ROW. There are more issues that would have to be addressed besides building a sidewalk such
as drainage and utilities. Technically there is a sidewalk already there and I don't know how I can require
the developer to construct a new one. If you have any issues I would be happy to discuss them tomorrow
morning when you are here for the Pre -PAC meeting. Thanks!
