Yes folks, the 1 year anniversary is fast approaching and here's the game plan:
- Send all of your LIDO amendments that you've noted throughout the year to Molly by the end of the week. She
has already taken the "LIDO Amendments List" from the "o" drive and incorporated those administrative
changes that we've added throughout the year. You only need to send her changes that were not on the list.
- Susan Hazlett is preparing a list of all of the comments the P&Z's collected through the "hear visitors on the
LIDO" portion of their agenda.
- Trey is working with Becky Nugent to publicize the annual review. Molly & Jane are working on an article to
put on the City's website advertising the review & soliciting input. There will also be a link available to submit
your comments to staff.
- Nat's writing an article for this month's dept. newsletter advertising the annual review.
- P&Z Workshop on 5/20 - Kick -off at P&Z. The information will be available on the website. (Will include the
administrative changes already identified, comp plan amendments throughout the year, other UDO changes that
staffs exploring and future comp plan amendments.)
- Dev'I Review Staff along with Jane & Trey will continue to work through the following issues: definition of
shopping center and required parking, C -1 vs. C -2 zoning districts with respect to retail & warehouse uses,
signage requirements in special districts, mini - storage in C -3 as a P *.

- Molly will incorporate the driving range requirements that Lauren put together.
- Molly's working on the Northgate revisions that Kim prepared. (Bridgette's formatting & putting it in to the
UDO.)
- Prochazka is working on clarifying "visible from the right -of -way" as referenced in the sign section. She's also
working on the attached signage and banner requirements as well as the special district signage.
- 6/3 P&Z Workshop - Staff will present comp plan review & UDO changes that we're identified. Molly's
preparing a handout to receive input from the P&Z re: any changes to the UDO. The handouts will be due back
from the P&Z by 6/10.
- 7/1 P&Z Meeting - Tentative public hearing date on all UDO changes & recommendations to Council. (We
selected this date since Scott Shafer will be back from New Zealand.)
- 7/22 Council Meeting - Tentative public hearing date to adopt changes.

Yes, I am familiar with the two issues related to signs. I met with Jennifer P. and Natalie about a week
ago on it also. Basically, we were looking at three issues:
1) end cap (side of building) signage. We would add some language that allowed a second sign on the
end -cap of any side of a building that faced a r -o -w
2) methodology for calculating square footage of a sign. We were considering allowing the calculation to
be made for each individual letter and /or logo. This is the methodology used by Bryan. If we went that
route, we may have to lower the 2 square feet we currently allow.
3) signs that cannot be read (visibility) from the roadway

Two things come to mind.
First I had asked Kelly several months ago to prepare an ordinance removing the prohibition to Live Oak
trees being within 30 feet of a street ROW from the LIDO. He said he would take care of it with the
anniversary clean -up items. This has also been mentioned to Steve Beachy, Ross, and Mark Smith so
they know that it is coming.
Secondly, seems like Kelly and Kim had worked on some language for changes to the sign ordinance that
was to be incorporated into the other changes this summer.

I thought we were waiting until the Task Force is done but this is better. Here, Nat
"A family is one or more persons occupying a single dwelling unit, provided that unless all members are
related by (1) blood, (2) adoption, (3) guardianship, (4) marriage, or (5) are part of a group home for
disabled persons, no such family shall contain more than 4 persons."
Then add to the definition of Group Home in the definitions section that it is a home as defined pursuant
to Chapter 123 of the Human Resources Code.

1. A premise with less than 75 feet of frontage shall be allowed to use one
Low Profile Sign.
2. A premise with more than 75 feet of frontage shall be allowed to use
standards for one Freestanding Commercial Sign located in Section 7AF,
Sign Standards, rather than one Low Profile Sign.
3. A premise with more than 150 feet of frontage shall be allowed to use one
Freestanding Commercial Sign or any number of Low Profile Signs as long
as there is a minimum separation between signs of 150 feet.
In lieu of one Low Profile Sign every 150 feet, hospital uses may have one
low profile sign located at each driveway.
4. Premises with less than 75 feet of frontage may be combined in order to
utilize signage corresponding to the resulting frontage as described in the
preceding two paragraphs.
S. No more than one Freestanding Commercial Sign shall be allowed on any
premises except when the site meets one of the following sets of criteria:
a. The building plot, as recognized on an approved Plat or Site Plan, must
be 25 acres or more in area with at least 1,000 feet of continuous
unsubdivided frontage on any major arterial street or higher (as
classified on the Thoroughfare Plan) toward which one additional
Freestanding Commercial Sign may be displayed (see diagram below);
or
Per Ordinance No. 2664 dated September 9, 2003.

UDO Change to Free Standing Sign Section 7.4.1.b
Section 7.4.1.b.1. Gas Stations: For the purposes of this section, the allowable area of fuel pricing may not
be greater than 30 percent of the total sign area.
Nat- This is what we came up with. This keeps the separate 16 square foot in area fuel pricing still an
option. This will allow them to have some area on the free standing sign as well. Let me know if you are
confused.

1. The area of the fuel price sign shall not exceed 16 square feet. The area allowable on any Freestanding
Commercial Sign or an Attached Sign shall not exceed 16 square feet in area or 30 percent of the total
sign area (The strictest of the two).

Good morning Tom,
I spoke with Glenn this morning regarding the SOE concept maps that we have been working on and potential
impacts to the Silk Stocking site. I've attached some information regarding the SOE ordinance and specific
issues relating to Silk Stocking. There are two main issues that we have been dealing with over the past several
months. The first deals with broader issues related to the current SOE requirements and providing adequate
locations for such uses. The second issue deals with Silk Stocking specifically and pending litigation.
There are several ways that we could deal with Silk Stocking specifically and legitimize their existing operation.
If the decision is to allow Silk Stocking to remain, I would suggest that we exempt them from the ordinance in
their current location. The code can be amended to provide an exemption provision for this specific property.
(We would need to consult with Harvey on this issue to make sure he agrees that this is a viable option.)
Exempting them from the ordinance allows Silk Stocking to continue as a non - conforming use and deals with
both locational and site specific compliance issues. We could modify the code in its current state to deal
with the immediate needs of Silk Stocking. At some point in the near future, we could deal with the broader
issues of the ordinance that impact the City as a whole.
If exempting this one property is not a legally viable option, we should consider removing the amortization
provisions in the ordinance altogether. This does have implications for the Adult Video site that we need to fully
explore with our legal staff.
