CITY OF COLLEGE STATION
As requested, we have reviewed our work order system to see if it was possible to retrieve any
information relating to customer calls pertaining to overflowing toilets. This type of information is not
available because it did not require a city crew to do any emergency maintenance work. When the
Black Eye Pea was in operation and an employee would call the Water Services Department to report
that their toilets were overflowing, a city employee would be dispatched to check for wastewater backing
up in the city wastewater collection system by opening manholes N33B2M024 and N33B2M023 on Jane
Street. If the manholes were clear, the city employee would inform the Black Eye Pea staff that it was
on the private side and that they needed to call a plumber. Another indicator that the problem was on
the private side was that only the restrooms and certain floor drains would back up, while the grease
interceptor would not be experiencing problems.
Because of the multiple calls to check on restroom fixtures overflowing, the Water Services Department
is requiring that the private side plumbing meet the International Plumbing Code for the subject property.
Regarding our on -site meeting yesterday, 27 May 2008, neither Pete Garcia nor myself can direct or
approve how you solve the problem that is between you, your plumber, and the tenant. We met with
you to discuss the previous problems that city staff had responded to phone calls about, a process that
would not hold up your tenant's Certificate of Occupancy (CO), and what timeframe was anticipated in
completing the project. It is our understanding that you will be correcting the plumbing so that it will
conform to the International Plumbing Code and that the work will be complete before 1 September
2008. With your commitment to meet the International Plumbing Code and working with the
Development Services Department through the process, we agree not to prohibit the Building Official
from issuing a temporary CO if the work has not been completed. The temporary CO will be good
through 1 September 2008.

Pete and I met with Steve Pittman (property manager), the plumber, and the renter today. I am to write a
letter Steve outlining anything that we have regarding the plumbing problems at the old Black Eyed Pea
location. They are going to do some work to resolve the plumbing not meeting the International Plumbing
Code and we are not going to hold up a CO but require the work to be completed by September 1, 2008.
I will copy you on the letter that I send to Steve.
