Jennifer has spoken with Bob Ruth, a local landscape architect, twice today about the proposed signage. He is proposing 2 freestanding signs (16.5' x 5.5') at the entrance to the complex, 3' setback from the ROW and within the sight distance triangle. They're very attractive brick columns with decorative spires on the top. However, both the ZO and UDO only allow 1 freestanding sign, 100 sq. ft. in area, maximum of 10' tall and 10' setback from the ROW. In their first conversation, Bob was very upset and asked that someone in Development Services just "take it on the chin" and approve it. Apparently, the materials and the signs have been ordered. Jennifer and I talked about it and we both feel strongly that he has many options. She discussed numerous options with Bob and he still wasn't satisfied. He said that he originally turned in a colored rendering of the entrance with the site plan and wanted to know why were just now objecting. Jennifer doesn't remember seeing the rendering. (Even if he had received it, there were no dimensions, etc., just a pretty picture.) He wanted to know who could approve the signs as proposed. Jennifer explained that the Zoning Official makes the final determination. He could then request a variance to ZBA. He felt like going to ZBA would take too long and he wanted to talk to Ron Silvia and /or Tom Brymer about the issue instead. He felt like they could force the issue with the Zoning Official. As you know, Luther is lined with multi - family projects that have been required to comply with the regulations. Let me know if you need more information. I visited the site today to confirm the location of the required egress point and observed the following conditions. Buildings 22, 23, 24, and 25 will be served by this emergency egress. The curb at the end of the parking lot is designed to be easily removable. This is evident from the non - monolithic pour on the curb; it is referred to as a knock off curb. This is normally used between phases of construction. The second phase of Melrose was allowed to be constructed with the above mentioned buildings having only one egress point because the secondary egress point was planned to be provided with phase three. This was shown on the proposed site plan for phase two and three. I was the Fire Marshal at the time of construction and required this egress point. The sale of the property does not diminish the necessity of this requirement. Therefore, I am still requiring the connection of the two complexes. The gate will only be opened by the Fire Department in case emergency and there is a need to evacuate residents from the area. I hope there can be consensus between the two parties.
