CONTRACTOR SHALL USE A TEXAS REGISTERED PROFESSIONAL LAND SURVEYOR TO PERFORM THE CONSTRUCTION STAKING AND TO VERIFY THE LOCATIONS OF ALL POTENTIAL ALIGNMENT CONFLICTS SPECIFICALLY CALLED FOR ON THE PLANS. CONSTRUCTION STAKING SHALL BE CONSIDERED INCIDENTAL AND CONTRACTOR SHALL INCLUDE COSTS IN RELATED ITEMS OF WORK. CONTRACTOR SHALL USE GRADE CONTROL TO ENSURE WATER LINE IS INSTALLED AT GRADES -AND ELEVATIONS SHOWN. 9. TEXAS LAW ARTICLE 1436C, PROHIBITS ALL ACTIVITIES IN WHICH PERSONS OR EQUIPMENT MAY COME WITHIN SIX FEET OF ENERGIZED OVERHEAD POWER LINES, AND FEDERAL REGULATIONS, TITLE 29, PART 1910. 180 (L) AND PART 1926. 550 (A) (15) REQUIRE A MINIMUM CLEARANCE OF TEN FEET FROM THESE FACILITIES. THE ABOVE LAWS CARRY BOTH CRIMINAL AND CIVIL LIABILITIES, WITH CONTRACTORS AND OWNERS BEING LEGALLY RESPONSIBLE FOR THE SAFETY OF WORKERS UNDER THESE LAWS.. 10. PRIOR TO BUILDING AND CONSTRUCTION THE CONTRACTOR SHALL CONTACT CITY OF COLLEGE STATION UTILITIES FOR APPROVED METHOD OF BRACING THE EXISTING POWER POLES IN THE CONSTRUCTION AREA. CONTRACTOR SHALL RESTORE ALL SPRINKLER AND/OR IRRIGATION SYSTEMS DISTURBED OR DAMAGED DURING CONSTRUCTION TO ORIGINAL CONDITION OR BETTER (NO SEPARATE PAY). 14. CONTRACTOR SHALL NOT USE RESIDENTS' WATER. 15. CONTRACTOR SHALL BE RESPONSIBLE FOR THE DISPOSAL OF ALL MATERIALS WHICH ARE NOT TO BE REINSTALLED OR SALVAGED ON THE PROJECT IN A MANNER THAT COMPLIES WITH ALL APPLICABLE LAWS AND REGULATIONS (NO SEPARATE PAY). 16. NO EXCAVATIONS SHALL BE LEFT OPEN OVERNIGHT. ALL EXCAVATIONS WHICH CANNOT BE BACKFILLED OVERNIGHT SHALL BE COVERED WITH STEEL SHEETING WHEN IN PAVED AREAS. FOR NON -PAVED AREAS STEEL SHEETING, WOOD PLANKING, OR MATERIAL WHICH IS APPROVED BY THE CITY AND TXDOT. PROTECT THE EXCAVATION AREA WITH TRAFFIC BARRICADES EQUIPPED WITH YELLOW FLASHING LIGHTS AND COMPLETELY CORDON OFF WITH PLASTIC CONSTRUCTION FENCING APPROVED BY THE CITY AND TXDOT.
