Attn: Travis Martinek 3608 East 29 Street, Suite 100 Bryan, Texas 77802 RE: Indian Lakes Development Dear Travis, In 2005 City of College Station staff made a determination that the Indian Lakes Phase 7 development was vested with respect to the fire flow requirement, and same has been presumed of the entire development until now. However, after a recent concern involving a waterline for Phase 13, City staff revisited this issue. A review of Texas Local Government Code §245.004(c) indicates that based on the nature of the constructed work, it falls under one or more of the exemptions to the vesting statute, and, therefore, should not be considered vested in the future. In further regard to Phase 13 subdivision, the subject street and waterline had largely been installed prior to any City review. Nevertheless, the City will allow the infrastructure to remain in place, but will require you to provide both the contractor's red -line certification of street waterline plans and correspondence from the Brazos County Engineer's Office of acceptable street construciton and drainage design and construction, and the Wellborn Water SUD regarding the SUD intent to serve water and acceptable waterline construction. To avoid the possibility of a situation like this happening again, we remind you to submit your construction plans for approval prior to beginning work. It is our intent to continue working with Smiling Mallard / Clarke Wyndham to outline vesting parameters for future phases of Indian Lakes.
