Good afternoon Becky - The following are the issues that I have site plan wise for C.O.:
1)Outdoor Lighting needs to be shielded from the adjacent single family neighborhood as was done for
phase I.
2)AII construction debris /equipment/materials will be required to be removed from the site with everything
graded with established ground cover.
3)Temporary curbing will be required adjacent to the Fedora property.
4)We will need a letter from the landscape architect stating that the shrubs in the buffer will be at 3 -feet in
height in one growing season. This letter will be on file for staff to re- inspect at the end of the first growing
season. The letter is a requirement prior to C.O. but is not conditioned on the actual growth and
re- inspection.

Lindsay,
Please find attached the parking table for the project as was submitted with the
first site plan that was approved. Nothing was changed. We did purchased the land
behind the car wash, which gave us an additional parking in excess of +/- 60 spaces.
The existing parking lot layout is on the SP -1 sheet and indicated by hash marks.
Please find attached the revised elevations as to what is being built on the ends.
We are trying to match the back building on Lot 5 & 6 as close as possible. Please keep
in mind the first elevations were approved with a building height of 16' with no issues
involving the building height, however we did change the finished building height to 11'
10" per the attached transmittal to Molly Hitchcock. We have stepped down the building
as indicated on the attached drawing. We have provided spot elevations on the north end
to Molly Hitchcock prior to having to provide them for the South end and that transmittal
is attached. We have marked on Sheet SP -1 the dimensions that were required for the
south end (the building distance to the fence).
We feel that this issue should have been addressed at the time of the first
submittal prior to a building permit being issued. Since that was not the case we
proceeded with construction only to have a stop work ordered issued not once but twice,
stemming from the building height. We have a tenant with a lease agreement with us and
time frame to complete this building and we now have lost +/- 2 weeks to date on this
job. As of this time we cannot afford to loose anymore time.
We would like to think that this information would resolve the issue at hand and if

Lance and Chris,
In regards to the building height and our request for the Administrative
Adjustment per our letter dated May 9th; it is our understanding that the Administrative
Adjustment for the building height has been denied; we will move the rear building line
back to the 27' 6" at Point #1 and Point #2 to meet the building height requirements per
the UDO. We will begin work at these two (2) areas on Friday, May 16, 2008, to resolve
the building height and set back issues.

Dear Lance,
This is in follow up to our conversation Tuesday, 11:00 a.m., April 29, 2008 and
today in reference to the above noted Building "E ". Please find attached a copy of the
Site Plan with (2) two areas ( #1 and #2) noted by "clouded ".
I am requesting that I be allowed to proceed with work in other areas than these
two (2) areas of concern to prevent further weather damage to the building and assure
that I can move my Dance Tenant's in the building in July as our lease states. Work
would not be performed in these (2) areas until I present you with dimensions (distance to
property line from building and height of structure) that met the 25' buffer and 2 to 1
height requirement. We would be allowed as discussed, to work on the South end (Dance
Expressions) and no C.O.'s would be issued until these two (2) areas are resolved.

I talked to Jim Woods yesterday afternoon at 5.
He wants the CO for the Dollar General store to be issued today (Friday).
Jim gave me a pretty long description of all that they have done and are wanting to do in their
development. He understands that the CO is being held because he has not completed all of the required
improvements on his site. He also understands that if he phases his development that he can set it up so
that he can limit the number of items that he needs to complete. What he wants us to do is to give him a
list of things that he can get done today that will allow him to get his CO. He has also said that if he has
broken or disregarded any rules he apologizes and just wants to get the CO. In his argument to me he
cites the fact that we have given him COs before without making him finish everything and that we should
do that again.
I have scheduled a meeting for 1:30 this afternoon with the development staff to get the background on
this project. After that meeting Jane & I will prepare our findings and our recommendation and let Mr.
Woods know what we have decided.

Chicken Express is considered part of the shopping center. You will need to keep in mind that once the
shopping center reaches 25% of restaurant/bar the more restrictive parking requirement kicks in for the
square footage that exceeds 25% and over. This may require more parking space. Please call if you
would like for me to explain in more detail.

GlacierJennifer: For our ultimate calculations on required parking, are we
assuming that all of the buildings on Wellborn fall under the 1/150? This
question comes from the review of definitions of Shopping Center and the
definition of restaurant, i.e. Chicken Express.
If I can assume that Chicken Express becomes a part of the Shopping Center
at 1/150, I can pick up 6 spaces from them. Chicken Express is 2,400. At
1/100 they require 24 spaces, at 1/150 they require 18.
Sorry to be a pain on this, but the definitions are not extremely clear.

Jeff this would be considered health studio (like Suzann's School of Dance) and would not be permitted to
go in the S.W. Business Center without the shopping center parking requirements.
Are you and Jim moving forward with the new site plan to include all four lots with a cross access and
parking agreement behind Jamison, as well as the property to the south?
I just want you to keep in mind that we just permitted your last tenant space available for office in the back
building that is allowed to go in until more parking is provided. I also want to bring to your attention that
Dollar General will not be able to get a CO with out the rest of the site developed out on lots 7 and 8.

GlacierJennifer: Had a call from a lady that wants to put an educational
business in the Wellborn Center. Her description is a Kindermusik type of
business, kids 4 and under with parents attending also. It is a
parent/child interaction type of class.
What do we classify this as?
Checking to see if this will not be retail, thereby allowing us to utilize
another classification other than retail, and get them in prior to the
parking lot resolution.

Findings regarding a request for issuance of a Certificate of Occupancy (CO) for Dollar General Store
located in the Southwest Business Center. Lots 7 &8 Block 2 Edelweiss Business Center, College Station
Texas.
Jim Woods, the contractor for the development, requested a CO on Thursday, July 15, 2004. The CO
request was denied for the following reasons.
• The project was not built according to the approved site plan.
• Construction on the site is not complete.
Jim Woods appealed the decision to the prescribed administrative process.
Mark Smith met with Jim Woods on Thursday
afternoon and listened to the appeal. Mr.
Woods acknowledged that the site was not
developed according to the approved site plan. , =:`
He explained that he was told that he would
need to submit a revised site plan that reflected
the actual plans for the site and that "phase
lines" would need to be provided so that the . -_ +► "
City could evaluate and CO the development in ^ ..: 1'
stages. Mr. Woods has submitted a new site �' — -►
plan showing phase lines but the new site plan
does not reflect the way the site has been
developed. Mr. Woods promised that he would
get a revised plan in and that all of the
necessary improvements would be installed. He 116,
also apologized for his failure to follow the plans.
Staff met to discuss Mr. Woods' appeal of the
ro. decision to deny the CO. We discussed several of
the items that remained incomplete and points
where the site development has deviated from the
• .., ,. approved plans. It was determined that without a
new site plan that clearly delineates the proposed
project phasing as well as how the site proposes to
develop that staff could not determine whether the
incomplete and improperly constructed items
would affect the Dollar General Store. We also
- 4x " discussed our experience with Mr. Wood and came
to the conclusion that in the past, promises and
apologies have been meaningless.
The mediation recommendation is to withhold the CO until a revised site plan is developed and approved
and all items related to the Dollar General Store's development are complete.
