This letter is to inform you that the above referenced property has received an administrative
adjustment of 9" into the front setback. The front setback requirement of 25' has been
reduced to 24'3".
According to the Unified Development Ordinance Section 3.15, the Administrator has the
authority to authorize adjustment of up to 10 percent from any numerical zoning standard set
forth in Articles 5, 6, or 7 of the Unified Development Ordinance. To approve the application
for an administrative adjustment, the Administrator shall make an affirmative finding that
specific criteria, as outlined in Section 3.15.E of the Unified Development Ordinance, have
been met.
The Administrator has found that:
Granting the adjustment will ensure the same general level of land use compatibility as
the otherwise applicable standards because the encroachment is one small corner of the
structure;
Granting the adjustment will not materially or adversely affect adjacent land uses or the
physical character of uses in the immediate vicinity of the proposed development; and,
Granting the adjustment will be generally consistent with the purposes and intent of this
UDO since the front setback of 24'3" is being maintained on a cul -de -sac lot.

Dear Mr. W.C. Lonquist:
This letter is to inform you that the above referenced property has received an
administrative adjustment for the architectural element that will extend 34.2" into the
required 15 -ft. side yard setback. This falls within the 10% variance that staff is
allowed to grant at an administrative level. (Section 7.1.3.1) Sills, belt courses,
cornices, buttresses, chimneys, flues, eaves, and other architectural features may
extend up to 18 inches into any required yard. This would leave (13) thirteen feet (6)
inches of side yard setback, 10% of 13 -feet 6- inches is (16.2) inches. Due to the fact
that the architectural element encroachment will not be contrary to the public interest,
staff is approving the 10% variance request to allow for the canopy to be installed
over the front doors.

because encroachment does not materially alter the character of the structure or its
use; and
Granting the adjustment will be generally consistent with the purposes and intent of
this UDO owing to the scale of the encroachment.
