Kelly and I spoke with Rox and Harvey regarding platting exemptions and thoroughfare compliance. I
think you guys will be pleased. Here's what we got:
The property is not exempt from platting as this middle portion is being divided out specifically for
development and includes the dedication of a public improvement (that being ROW for Rock Pr.).
Therefore the entire 600 acres has to be included in a master development plan. We will allow the
primary access from Greens Prairie Road but the street size shall be determined based on a study using a
proposed build-out scenario to include the portion adjacent to Greens Prairie. Secondary access to Rock
Prairie is encouraged.
The public's right to access along Rock Prairie is not in question and thus this is no different than an
existing "right-of-way". Therefore the additional 9 feet (plus or minus) of ROW for Rock Prairie is all that
will be required. No construction will be required as this would be an off-site improvement. However the
additional right-of-way will be required along the full length of the original 600 acre tract as the exemption
does not apply and we would not recommend phasing such that the right-of-way is delayed until further
development plans are made for the remainders.

Dear Spencer:
Thank you for your participation in the meeting with my clients, Joe and Janet Johnson, and their
engineer, Joe Schultz, on March 4, 2004. Also, in attendance at that meeting were Bob Mosley,
Dale Schepers, Fred Anderson, Stan Stephen, Kelly Templin and Natalie Ruiz.
As we discussed, the Johnsons are in an unfortunate position because Wellborn Special Utility
District (WSUD) is the holder of the Certificate of Convenience and Necessity to provide water to
the area but WSUD does not have a franchise agreement with the City of College Station (the
"City") to allow their water lines to be located in the public utility easements that will be dedicated
by plat completed in accordance with the City's subdivision ordinance. The water lines will, as
required by the City, be constructed in accordance with City standards. It was our understanding
from the meeting that you are going to pursue a limited franchise agreement with the appropriate
departments with the City and expect to have an idea about how the matter will be resolved within
a few days.
Again, on behalf of my clients, I want to thank you for your assistance in agreeing to help in getting
this matter resolved. As you know, the development is at a standstill until we resolve this matter.

We are evaluating the feasibility of a development of 100 acres of the Anderson/McCullouch 644 acre
tract located at the southeast corner of Green Prairie and Rock Prairie Road. We are ready for a pre-dev.
meeting, but have the following questions:
1) Land Use plan shows low density residential. The plan would call for a portion of the development to
be medium density - is this possible?
2) The nearest sanitary sewer line is 3000 feet away. Will the city allow a package treatment plant until
such time as city service is available?
3) Where is the nearest water line and what is its size? What size line will the city require to be extended
southeast along Rock Prairie?
4) 1 understand that Wellborn's service area is east of the original city limit line. How will the city and
Wellborn interface with respect to water service?

Response to Staff Review Comments (No. 1)
Engineering/Planning:
1. Drainage easements will not be considered a part of the lot area.
2. Residences in the area of the first 100' of the centerline of Rock Prairie Road
will have electrical service provided by College Station Utilities.
Variance requests will be addressed with the Preliminary Plat.
4. The Parks Board meeting was held April 20, 2004, and the Parks Board
agreed to accept the fee in lieu of land dedication.
5. Land uses have been shown for the surrounding area, and the existing
structures have been identified.
6. Land uses and proposed densities have been shown for the entire tract.
7. A street connection to the east has been shown.

All comments have been addressed.

Item: Consideration, discussion, and possible action on a Master Development
Plan (MDP) for the Williams Creek Subdivision consisting of 642.82 acres
(212.14-acres of the Williams Creek Subvision and 431.68-acres of the
Anderson-Stephen Tract), generally located at on the south-east corner of
Greens Prairie Road East and Rock Prairie Road.
Applicant: Joe & Janet Johnson
Staff Recommendations: Staff recommends approval of the master
development plan as submitted.
Item Summary: The Williams Creek Master Development Plan (MDP)
encompasses 642.82 acres located on Greens Prairie Road East. The Master
Development Plan proposes Single Family Low Density (1/3-2 DU/AC) for the
majority of the tract. The remaining 19.53 acres located at the corner of Greens
Prairie and Rock Prairie Road is proposed for Retail Regional.
Comprehensive Plan Considerations: The subject property is in compliance
with the Land Use Plan. The property will be bound on the north by Greens
Prairie and on the west by Rock Prairie Road. The Thoroughfare Plan shows
Greens Prairie to be a Major Arterial and Rock Prairie to be a major collector.
The main entrance of the proposed development will be off of Greens Prairie
Road. There are two access points (residential streets) being proposed off of
Rock Prairie. To the east and to the south, the property backs up to
approximately 242 acres of flood plain.
Item Background: The subject property was annexed into the City of College
Station limits November of 2002 and is currently not platted.
March of 2004 the City Council approved a zone change from A-O Agricultural
Open to A-OR Rural Residential for the 211.14 acre-tract of the Williams Creek
Subdivision. A-OR has a minimum lot size of 1-acre, whereas the remainder of
the 411.68 acres is currently zoned A-O which the minimum lot size is 5-acres.
Related Advisory Board Recommendations: The Parks Board met on April
20th and accepted fee in lieu of the park land.

Jennifer/Spencer,
thanks for getting the comments out so quick.
Comment Mo. 3. Since the variances are not to be addressed at this time, I
think it is appropriate to remove note 8 and the reference to 15' wide
easements in notes 11 and 13. Let me know if you if you agree.
Comment No. 7. FYI - We will show a street connection to the east reserved
tract.
