Item: Public hearing, discussion, and possible action on a Conditional Use
Permit for a night club at the existing Texadelphia Sandwiches, located at 201
College Main.

Applicant: William J. Madden, property owner
Staff Recommendation: Staff recommends approval of the Conditional Use
Permit.
Item Summary: The applicant is requesting a Conditional Use Permit for a night
club in order to add entertainment - oriented uses to the existing Texadelphia
Sandwiches Restaurant. The applicant is proposing both live and recorded
indoor music and attractions such as: pool tables, domino tables, and
dartboards. The hours of operation will be extended to 11:00 p.m.
No changes to signage or the building facade are being proposed at this time.
Comprehensive Plan Considerations: The Land Use Plan designates this
entire area for redevelopment. Texadelphia renovated the structure in 1999 and
the Northgate Review Board approved all facade improvements at that time.
College Main is classified as a Major Collector on the Thoroughfare Plan.
The property is surrounded by Kyoto Sushi to the south across Patricia Street,
A &M United Methodist Church education and fellowship building to the east
across College Main, the Northgate promenade in the rear of the building, and
The Baptist Student Center to the north of the property.
Item Background: The property was incorporated as part of the original City
limits in 1938. This area was zoned NG -1 Historic Northgate in 1996 as part of a
City initiated rezoning of the Northgate area.
A Conditional Use Permit was recently granted for the reconstruction of the
education and fellowship building for A &M United Methodist Church across
College Main.
Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may permit a conditional use subject to
appropriate conditions and safeguards, when after public notice and hearing the
Commission finds that:

1. "The proposed use meets all the minimum standards established in the
ordinance for the type of use proposed." Staff conducted a technical review
and found general compliance.
2. "That the proposed use meets the purposed and intent of the ordinance and
is in harmony with the development policies and goals and objectives as
embodied in the Comprehensive Plan for Development of the City. The
request is in compliance with the Comprehensive Plan.
3. "That the proposed use will not be detrimental to the health, welfare, and
safety of the surrounding neighborhood or its occupants, nor be substantially
or permanently injurious to neighboring property." The public hearing is an
opportunity for the Commission to measure the potential impact on
surrounding land uses.
The Commission may impose additional reasonable restrictions or conditions to
carry out the spirit and intent of the ordinance and to mitigate adverse effects of
the proposed use.
Unless the public hearing bring to light any new information indicating potential
negative impacts, Staff recommends approval.
Commission Action Options: The Commission acts as a recommending body
over the Conditional Use Permit. The options regarding the use permit are:
1. Approval as submitted;
2. Approval with conditions relating to specific time limitations;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.
