APPLICATION WILL NOT BE CONSIDERED COMPLETE WITHOUT THE FOLLOWING INFORMATION ADDRESSED: State how the following issues will be addressed: 1. Indicate how this use and site plan will not be detrimental to the health, welfare, and safety of the surrounding neighborhood, by answering the following: a. Approximate the distance to the nearest residential area and indicate the housing type (single family, duplex, multi - family, etc.) The nearest multi - family residential area, the Traditions Dorm, is approximately 300 ft from the subject property. The nearest duplexes and single family residential areas are approximately 650 and 700 feet respectively from the subject property. b. The College Station Codes limit noise levels to 65 d.b.a. from 7:00 A.M. to 10:00 P.M. and to 55 d.b.a. from 10:00 P.M. to 7:00 A.M. Estimate the noise levels produced from the proposed use as heard from all property lines. The property owner is requesting the CUP with the intention of complying with all of the City Codes. The music portion of the request is for only inside the building. If necessary for compliance the property owner will provide additional noise abatement materials to the building. c. Approximate the distance to the nearest church, school, or hospital. These measurements must be taken from front door, along property lines, to front door. The property currently has an alcoholic beverage license. At the time that the license was granted it was determined that the distance from the subject property to the A &M United Methodist Sanctuary was greater than the required 300 feet. To our knowledge, the location of the sancturav has not changed and no structural changes are being proposed for the subject property, which would indicate that the prior measurement of greater than 300 feet is still valid. 1- Aug -02 2 of 4 d. Describe the proposed activities and entertainment attractions. The property owner is requesting the CUP to allow a wider range of uses of the property. At this time there is not a specific format being planned, the owner simply would like to attain permission for a reasonable range of entertainment uses for the property, allowing for the possibility of a change in the business format in the future. Realizing that a completely open -ended use request would not be reasonable or prudent for the Commission and Council to grant, the owner is simply requesting the following. The request is to allow for indoor music (live and recorded), without a dance floor, and entertainment attractions similar to and including but not limited to pool tables, domino tables and darts. It is anticipated that, the impact on pedestrian and vehicular traffic, and the number of employees would remain similar to that of the existing restaurant establishment. A change in the opening hours is not proposed, however, the closing time would extend from the existing 9 P.M. to 11 P.M. closing to the full hours allowed under City Ordinances. e.
