Box 10103 College Station, TX 77842 -0103 Re: University Drive Sewer Participation Dear Chuck, First of all, I would like to thank you for your patience in allowing us the time to complete our research into the recent development in this area and to coordinate this issue between our various departments and divisions. It is our understanding that an acceptance of the City's 9/12/01 offer was never received. We do not show any documentation that the required development agreement was pursued beyond that point. We are also not aware of any ongoing Economic Development discussions that were also a part of the negotiations that generated the original offer. For these reasons, we consider the offer to have expired. That said, we would like to restate our willingness to pursue a Development Agreement that would involve City participation in increasing sanitary sewer capacity beyond the limits of your client's project, in exchange for development of your client's property in a manner desirable to the City. At this time, we believe such an agreement would include the following salient points. 1) The City of College Station would engage the services of a design engineer, and cause the preparation of construction plans and specifications for the improvements identified in the 1998 Kling Engineering Report. The design engineer would also prepare exhibits for any necessary easements. 2) The Developer would cause any identified easements to be dedicated to the City, using approved City of College Station forms. The Developer would be responsible for all costs of easement acquisition beyond exhibit preparation. If purchase of the easements is required to meet desired development timing, the developer shall also bear such costs. 3) The Developer would cause the construction of the identified improvements in conjunction with development on his property using the construction documents provided by the City. The Developer would bear the construction costs of the improvements required. 4) As projects are completed on Developer's property, the City would reimburse the Developer for costs in providing additional capacity, in relation to the benefits to be received by the City in terms of property value increase, projected sales tax revenues, and utility service revenue. These reimbursements could either be negotiated at the time of agreement preparation with appropriate performance guarantees, or a formula could be determined that would allow calculation of a reimbursement as each business is completed. 5) A maximum amount of reimbursement would be included in the development agreement, and would equal the estimated cost that could be anticipated for the City to provide the easement acquisition and improvement construction for the identified capacity increase. Once you have reviewed this information with your client, I would be glad to set up a meeting with applicable City Staff and we can proceed with further negotiation of the details of such an agreement. The following page is a list of staff review comments detailing items that need to be addressed. If all comments have been addressed and the following information submitted by Tuesday, May 6, 10:00 a.m., your project will be placed on the next available Planning and Zoning Commission meeting scheduled for, Thursday, May 15, 2003, 7:00 p.m. in the City Hall Council Chambers, 1101 Texas Avenue. Two (2) copies of the revised final plat; One (1) Mylar original of the revised final plat; and One (1) copy of the digital file of the final plat on diskette or e-mail to nmanhart@ci.college- station.tx.us Upon receipt of the required documents for the Planning & Zoning meeting, your project will be considered formally filed with the City of College Station. Please note that if all comments have not been addressed your project will not be scheduled for a Planning & Zoning Commission meeting.
