The undersigned hereby makes application for the abandonment of that portion of the
above right -of -way particularly described in Exhibit No. 1, attached. In support of this
application, the undersigned represents and warrants the following:

Tots and block, and the subdivision in which the above described right -of-
way /easement is situated, together with the record owners of such Tots.
4. Attached, marked Exhibit No. 3, is the consent of all public utilities to the aban-
donment.
5. Attached, marked Exhibit No. 4, is the consent of the City of College Station staff
to the abandonment.
6. Attached, marked Exhibit No. 5, is the consent of all the abutting property

Field notes of a 40' wide strip or parcel of land, lying and being situated in the
Morgan Rector Survey, Abstract No. 46, College Station, Brazos County, Texas, and
lying diagonally across Lot 17, Block 1- Emerald Forest, Phase Two according to the
plat recorded in Volume 453, Page 905, of the Deed Records of Brazos County,
Texas, and being more particularly described as follows:

BEGINNING at the'/" iron rod set in the north right -of -way line of Emerald
Parkway - 90;' right -of -way located at the beginning of the transition curve from
Emerald Parkway to Rosewood Drive, having a radius of 25.00 feet, said' /" iron rod
being near the southwest corner of Lot 17, Block 1;
THENCE Northwesterly along said curve for an arc distance of 39.27 feet to a
'A" iron rod set at the end of this transition curve and in the east right -of -way line of
Rosewood Drive - 60' right -of -way, the chord bears N 68° 14' 23" W - 35.36 feet;
THENCE N 23° 14' 23" W along the east right -of -way line of Rosewood Drive,
for a distance of 7.01 feet to a 60d nail set at the southerly west corner of the
beforementioned 40' drainage easement;
THENCE along the northwest line of the 40' wide drainage easement as
follows:
N 38° 47' 21" E for a distance of 146.15 feet to a 60d nail set,
N 14° 54' 47" W fora distance of 14.53 feet to a 60d nail set in the
common line between Lots 16 and 17, Block 1;
THENCE N 74° 46' 12" E along the common line between Lots 16 and 17,
