KNOW ALL MAN BY THESE PRESENTS:
COUNTY OF BRAZOS
WHER.EAS, on April 11, 2002, the City Council of the City of College Station resolved
that there was a public necessity to acquire land for the extension of Longmire Drive South and
authorized the City Manager to establish and approve the amount of just compensation to acquire
a fee ai mple interest in land acquired for the extension of Longrnire Drive South; and
WIBREAS, the City Council also resolved to waive or partially waive statutory paving
assessments against parcels abutting the roadway from which may portion of said parcel was
needed by the City for the right for Longmire Drive South if the property owner conveyed
the portion of the property necessary for tb ri of- -way to the City, and
WHEREAS, the City Maz. ger waa authorized in said resolution to execute waivers on
behalf of the City of College Station where the value of the assessment was comparable to the
portion of the property acquired for the right-of-way or where the value of the aesesanlent was
used to offset the value of the portion of the property acquired; and
WHEREAS, Oakwood Custom Routea Group, Ltd., has conveyed the property described
in Exhibit "A ", attached hereto and incorporated herewith, to the City valued at 571,341.00 by
General Warranty Deed dated September 23, 2003, filed is Volume 562 . Page of
the Official Records of Brazos County; and
WHEREAS, on March 27, 2003, the City Council resolved to assess the oo t of
improvements for the Longmire Drive South extension against abutting property owners;
NOW, THEREFORE, for and in consideration of the sum of $71,341.00 in the form of
real property conveyed in fee simple to the City to be used as right -of -way for Longrnfre Drive
South in Project Number ST -0100 which value has been deteruuned by an independent appraiser
as the just compensation for the property, and S17,328.00 cash is -hand paid for the balance of the
assessment owed after the vffsct of the value of the real property, the receipt of Which is hereby
acknowledged and confessed, the City of College Station, by and through its City Manager, does
by these presents waive the statutory paving assessment for thia Project No. ST -0l00 with
respect to Oakwood Customs Hots Group, Ltd.'s, undivided interest in the property more
particularly described by metes and bounds in the attached Exhibit `B ", and releases any
purchaser, title company, and closing agenta in the trimsfez of title to the above - described
property now owned by the said Oakwood Custom Home Group, Ltd., Brazos County. Texas.
