PROPERTY: Being all that certain lot, tract or parcel of land lying and being situated in Brazos County, Texas, and being a part of Lots One (1), Three (3), Four (4) and Five (5), Block One (1), SUTTON PLACE, an addition to the City of College Station, according to plat recorded in Volume 401, page 403, Deed Records of Brazos County, Texas, and being more particularly described by metes and bounds in the attached Exhibits "A ", `B ", "C" and "D ". This conveyance grants the non - exclusive rights herein specified only as to that portion of the above - described property more particularly described on the attached Exhibits "A ", `B ", "C" and "D" known as the "Easement Area," to erect, construct and install, and thereafter use, inspect, repair, maintain, reconstruct, modify, make improvements to, and remove the following located in the Easement Area: 1. pedestrian and bicycle trails and foot bridges with hand rails; 2. any public improvements or structures as are reasonably necessary for the full enjoyment of the Easement Area as a pedestrian walkway and bicycle path and for the health and safety of the public, including irrigation, benches, kiosks, trash receptacles, culverts, signage, landscaping, emergency call boxes, public art, and bicycle racks; 3. equipment, guy wires and anchors for such lighting in the Easement Area as is reasonably necessary for the full enjoyment of the Easement Area as a pedestrian walkway and bicycle path and for the health and safety of the public; and 4. drainage ditches, drainage pipes and all other drainage structures, surface or subsurface. GRANTORS expressly grant to GRANTEE for use by the public the right to use GRANTORS' adjoining property to access the pedestrian trails and bicycle paths and foot bridges in the Easement Area. Upon development of the GRANTOR'S adjoining property, such right is limited to areas designated by GRANTOR and approved by GRANTEE as public access areas. The rights granted to the public in this paragraph will not, in any way, limit GRANTORS' right to further develop or to construct improvements on its adjoining property from time to time provided however, that any such development or construction does not impair the GRANTEE's use of the Easement Area or the rights granted herein, or unreasonably interfere with or impair the access by the public to the GRANTEE's Easement Area. Any damage to GRANTEE's improvements caused by GRANTOR's development or construction shall be repaired promptly at GRANTORS' sole cost and expense. o /group/legal/projects /wpc trails /easements/easement final #1.doc CR:js 4/12/02 D e Ek Vol 'et 00775234 OR 4611 8 GRANTORS expressly grant to GRANTEE the right to ingress and egress over GRANTORS' adjacent lands, in areas mutually designated by both parties, from time to time for the purposes of gaining ingress and egress to and from the Easement Area for the purposes described hereinabove, as well as to cut, trim, control and remove trees, foliage, roots, brush, other vegetation and obstructions within or along the Easement Area or on the adjacent property of GRANTORS only when necessary to prevent material and imminent damage to the pedestrian walkway, drainage structures, or any improvements, equipment or operations related to the pedestrian walkway or drainage structures, or to prevent immediate harm to the pedestrian public using the Easement Area. It being understood and agreed that any and all equipment or structures placed upon the Easement Area by GRANTEE shall remain the property of GRANTEE. The rights granted to GRANTEE herein are nonexclusive and GRANTOR expressly reserves the right to use the Easement Area for drainage, utilities and paved areas, and to grant other estates in the Easement Area, provided such uses and grants do not interfere in GRAN 1'EE's sole discretion with the use of the Easement Area for the purposes set forth in this instrument or damage the improvements in the Easement Area. GRANTORS expressly subordinate all rights of surface use incident to the mineral estate to the above - described uses of said surface by GRANTEE, and agree to lender's subordinations on behalf of GRANTEE. GRANTORS will provide GRANTEE with the names and addresses of all lenders. RESERVATIONS AND RESTRICTIONS: 1. Mineral reservation from Brentwood, Inc. to John C. Culpepper, Jr., dated July 2, 1980, recorded in Volume 455, page 41, Deed Records of Brazos County, Texas. 2. Estate created by Oil and Gas Lease from Brentwood, Inc. to Charles F. Decker, dated January 25, 1978, recorded in Volume 391, page 94, Deed Records of Brazos County, Texas. 3. Estate created by Oil and Gas Lease from Brentwood, Inc., to Inexco Oil Company, dated February 8, 1985, recorded in Volume 776, page 393, Official Records of Brazos County, Texas. 4. Estate created by Oil and Gas Lease from Brentwood, Inc., to Central Plains Oil & Gas Corporation, dated September 13, 1991, recorded in Volume 1364, page 244, Official Records of Brazos County, Texas.
