Applicant: Joseph and Dorothy Mikeska, Property Owners Staff Recommendations: Staff recommends approval of the rezoning. Item Summary: This property is the site of the existing Wellborn Road Veterinary Medical Center. The requested C -2 Commercial Industrial zoning is the only district that allows for both indoor and outdoor animal care facilities. A rezoning to C -2 would bring the existing use into compliance with the Unified Development Ordinance. The surrounding properties are zoned A -O and are largely undeveloped. Comprehensive Plan Considerations: The Land Use Plan for Annexation Area # 1 was adopted earlier this year and shows this property and the other Tots in the Rock Prairie West Business Park subdivision as light industrial, so this request is in compliance with the Land Use Plan. Rock Prairie West is shown as a minor arterial on the Thoroughfare Plan. Old Wellborn Road was recently classified as a major collector in this area, but is not built to that standard. The lot meets all C -2 requirements. Item Background: The property and the existing Veterinary Clinic were annexed into the City as part of Annexation Area #1 in 2002 and zoned A -O at that time. This lot was platted as part of the Rock Prairie West Business Park subdivision when the property was still in the City's Extra Territorial Jurisdiction (ETJ). Lot 9 of Rock Prairie West Business Park was rezoned C -2 earlier this year for the development of a carpet warehouse. Commission Action Options: The Commission acts as a recommending body on the question of rezoning, which will be ultimately decided by City Council. The Commission options are: 1. Recommend approval of rezoning as submitted; 2. Recommend a less intense zoning classification; 3. Recommend denial; 4. Table indefinitely; or, 5. Defer action to a specified date. Infrastructure and Facilities INFRASTRUCTURE AND FACILITIES Water: The City has a utility plan that was compiled for purposes of serving the newly annexed area, Annexation Area #1, with domestic water and fire flow capacity. The City does not have a water line in the vicinity to serve this property at this time. There is a 4" Wellborn Water line along Old Wellborn Road, which currently serves the property with domestic water. The Wellborn line does not serve this property with fire flow capacity. In order for any new structure to be constructed at this location, the owner will need to construct a City water line to the site or request a variance to the fire code through the Building Official and Fire Marshall. The fire code requires that a commercial structure have access to a fire hydrant that supplies specified fire flow volumes based on building area and building materials. Sewer: The City's utility plan for this area shows a sewer main to be extended into this area in order to serve Annexation Area #1. Currently there is no sanitary sewer system in the area. The property currently uses an OSSF. Streets: The portion of Old Wellborn Road from Rock Prairie to North Graham was classified as a major collector earlier this year. It is not built to City standard. The required ROW is 70 -ft. Off-site Easements: A shared access easement is platted in conjunction with the adjoining property to the southeast. This was done to limit the driveways onto surrounding thoroughfares. Drainage: Future development on this property is required to comply with the City's Drainage Policy and Design Standards. Flood Plain: None Oversize request: None at this time. Impact Fees: This property is in the Steeplechase / Wellborn Road Sanitary Sewer Impact Fee Area (03 -02). The current impact fee is $322.07 per Living Unit Equivalent. Impact fees are determined and paid at the time of building permit.
