Subject Property: The following lot dimensions are approximate, please refer to the enclosed site plan for more detail. 65' of frontage along Rocky Mountain Drive 119' northwest (side property line) 90' northeast (rear property line) 113' southeast (side property line) Frontage: Approximately 65 feet on Rocky Mountain Drive Access: Via a driveway from Rocky Mountain Drive Topography & Vegetation: Relatively flat and some existing trees Flood Plain: Not within the floodplain VARIANCE INFORMATION O:\ group\ deve _ser\stfrpt\zngstfrpt\honda.doc Setback Required: A side building setback of 7.5 feet is required for R -1 Single Family Residential lots. Setback requested: A side setback of 5.07 feet. Case Overview: This case involves an error made by the builder in establishing the 7.5 -foot side setback. The result is an encroachment that reaches 5.07 feet from the property line to the closest part of the home; thus the applicant is requesting a side setback variance of 2.43 -feet. ANALYSIS Special Conditions: As a Special Condition, the applicant states: "An error occurred when the front left stake of the property line was established." Hardships: As a Hardship the applicant states: "The house is currently sold and we cannot get clear title because of this mistake. Alternatives: The applicant has offered no alternatives SPECIAL INFORMATION The applicant has stated that the variance will not be contrary to the public interest by virtue of the following facts, "the house will be closer to the left property line and is not going to affect anybody." All building permits now states that one of the responsibilities of the builder is to provide the string line for all building setbacks and easements on foundation inspections. If the string line is not up when the inspector performs the foundation inspection the builder will be red tagged. It is the builder's responsibility to make sure that the string lines are in the correct locations. Ordinance Intent: Building setback requirements usually allow for some degree of control over population density, access to light and air, and fire protection. These standards are typically justified on the basis of the protection of property values.
