Greensword Phase 3 Rezoning

Agenda Caption: Public hearing, discussion, and possible action on a rezoning for
Greensworld Phase 3, located along Earl Rudder Freeway near the southeast corner
of University Drive, from C -2, Commercial - Industrial, and R -1, Single - Family
Residential, to C -1, General Commercial and A -O, Agricultural Open.
Recommendation (s): The Planning and Zoning Commission will consider the
request at their August 7, 2003 meeting. Their recommendation will be reported to
the Council. Staff recommends approval of this request.
Summary: The applicant is requesting the rezoning in order to construct a hotel
(Hampton Inn) with a restaurant pad site. These uses were formerly allowed in C -2
zoning districts; however C -1 uses are no longer allowed in C -2 districts under the
U DO.

• The coversheets will ideally be no more than one page in length.
• Any supplemental information including item background, if necessary, is to be included
as an attachment.
• At the top of the coversheet include:
• The date of the meeting.
• The type of item. Workshop, consent or regular. Include only the title that describes
your coversheet and delete the others from the coversheet.
• The title of the agenda. This should be a brief phrase that describes what the item
is.
• The coversheet will be to the City Manager and from the Department Director.
• Coversheets will be placed in file folder on the corresponding vision statement.

Item Background:
This rezoning is for two lots consisting of approximately 3.4 acres bound by
undeveloped R -1 to the north and east, the frontage road for Earl Rudder Freeway to
the west, and C -2 developed as Douglass Nissan to the south. Under the UDO
permitted C -2 uses primarily serve other commercial and industrial enterprises.
Permitted uses in C -1 function to serve the entire community and its visitors.
Lot 2 is primarily floodway and floodplain of Carter Creek. Since his initial application
for rezoning, the applicant has amended the request from C -1 for Lot 2 to A -O.
The property was annexed into the city in 1958 and platted in 2001. A site plan for a
Hampton Inn was turned in to the city on May 9, 2003; however, a complete
submittal was not made before the effective date of the UDO; thus the proposed
hotel use was not vested.
The Land Use Plan shows Lot 1 and properties to the south to be Regional Retail. Lot
2 is shown on the Land Use Plan as Park. The greenway is designated as Priority 2 in
the Greenway Master Plan.
