Staff reviewed the above - mentioned rezoning as requested. The following page is a list
of staff review comments detailing items that need to be addressed. Please address
the comments and submit the following information by Monday, November 4, 10:00
a.m. to be scheduled for the Planning & Zoning Commission meeting scheduled for
Thursday, November 14, 2002, 6:00 p.m. in the City Hall Council Chambers at 1101

PLANNING
1. The PDD rezoning for Spring Creek was passed with the understanding that
a "welcoming pedestrian environment" would be created and that Common
Area No. 2 would be an attractive, landscaped entrance to the Spring Creek
neighborhood and to the residential portion of the greater tract. As this plan
does not meet the spirit of the rezoning, please remove the wooden fence
shown three feet behind the sidewalk. Please show the extent of landscaping
that will be involved and other fencing proposals.

PLANNING
1. Please extend the 6 -ft. sidewalk across the easements to the abutting common
area.
2. Please provide landscaping and irrigation plans.
3. Please provide information on fencing: location, material, height, etc.

ENGINEERING
1. Is connecting a private sewer preferable at the manhole or in mid -line? If the lateral
connection is greater than 2 -ft from the bottom of manhole, you are required to
install a drop manhole connection. Both scenarios require digging to the flow depth
of the line. Please advise.

SUBJECT: Rezoning For Spring Creek Townhomes (Crowley) (REZ)
This item must be removed from the table before it may be reconsidered.
Item: Public hearing, discussion, and possible action on a rezoning from R -3 Townhouse
and A -O Agricultural Open to PDD -H Planned Development District - Housing for 16.316
acres of the Robert Stevenson Survey A -54 located 1 /2 mile north of Greens Prairie Rd.,
west of SH 6. (02 -225)
Applicant: Wallace Phillips for Spring Creek CS Development, Ltd.
Staff Recommendations: Staff recommends approval of the rezoning as proposed.
Item Summary: The Commission considered the rezoning at the November 14, 2002
meeting and tabled the item so staff and the applicant would be able to further discuss the
proposal. After alterations were made to the proposal, staff feels the benefits to the
community proportionately relate to the meritorious modifications requested.
The applicant has proposed approximately 12% of the total area to be dedicated common
areas. These areas, which include the entrance of the neighborhood from Oxburgh Drive,
will be landscaped and /or left as grass. In addition, five feet of the properties along
Decatur Drive and the entrance into the neighborhood along Heath Drive will be dedicated
streetscape easements to be maintained by the homeowners association. Also, six -foot
sidewalks are proposed to connect neighborhood parking areas and cul -de -sacs with other
areas of the Crowley tract, and the neighborhood parking lot with another section of the
neighborhood. Staff feels the pedestrian environment has become more welcoming in the
new proposal, especially as it relates to movement along Decatur.
To accomplish this, the developer has requested meritorious modifications to parking in
the right -of -way, setbacks, and the ability to plat two adjacent lots instead of three in one
area as shown on the concept plan.
Commission Action Options: The Commission acts as a recommending body on the
question of rezoning, which will be ultimately decided by City Council. The Commission
options are:
1. Recommend approval of rezoning as submitted;
2. Recommend a Tess intense zoning classification;
3. Recommend denial;
4. Table indefinitely; or,
5. Defer action to a specified date.
