Dear Ron:
You have asked me to describe for you the scope of the easements reserved by MBO Corporation
in its deed to Ray Walker, Trustee which was executed on November 17, 1997, and recorded In
Volume 2978, Page 316 of the Official Records of Brazos County, Texas (the "Deed") by David
Owen. The Deed conveyed two tracts of land to Ray Walker, Trustee. The land Is configured in
the nature of a "flag lot". The `pole" portion of the flag is Tract One In the Deed and the 'flag'
portion is Tract TWo In the Deed. There were two (2) easements reserved in the Deed to benefit
the adjoining MBO tracts.
Easement #1
This easement is a non - exclusive, 20 foot public utility easement which was to have been platted
and located along the western boundary of the 'pole Ior.
Easement #2
This easement provides MBO or its assigns a non - exclusive right to use the ''pole or to gain
access to its land on either side of the "pole" and to use the "pole lot" to accomodate drainage from
and to either of the tracts adjoining the "pole'. It is important to note that MBO's use of the
easement may not interfere with SAE's use of the easement for ingress and egress. By the same
token, they may not preclude you from using the "pole" for access and drainage. There Is a
provision for cost sharing in the maintenance of the roadway which is to be proportionate based
upon use. In other words, if the MBO tract has 20 vehicle trips per day and the SAE tract has 40
vehicle trips per day, MBO would pay a third of the cost of the maintenance and SAE would pay
two - thirds of the costs of the maintenance.
