Please keep in mind that staff' s responsibility is to provide the Planning & Zoning Commission with all pertinent facts of a development case, but that staff is not acting as an advocate for the applicants. Therefore, it is in the applicant's best interest to send a representative to the Planning & Zoning Commission meeting to speak on behalf of the proposal. This item is scheduled for the Thursday, December 12, 2002 Planning & Zoning Commission Meeting. This meeting will begin at 6:00 P.M. in City Hall Council Chambers. STAFF REPORT Project Manager: Jennifer Flanery Date: December 4, 2002 Email: jflanery@ci.college- station.tx.us Item: Discussion and possible action on a Final Plat for the Simmons Addition (FP) 3.12 acres located at 3435 Barron Cut -off Road. (02 -214) Applicant: Kerr Surveying, Agent for property owners John and Joyce Simmons Staff Recommendations: Staff recommends approval of the final plat. Item Summary: The Simmons are final platting in order to replace a mobile home on the property. Comprehensive Plan Considerations: The Land Use Plan designates this area as Single Family Residential. The property is located adjacent to and takes access to Barron Cut -off Road, which is not classified on the Thoroughfare Plan. Item Background: The property was annexed into the City in 1995 under the A- O zoning classification. The property was recently rezoned from A -O to A -OX Existing Rural Residential on December 5, 2002. A variance to the preliminary platting requirement was received from the Planning and Zoning Commission in September of this year. The original property consisted of 37.615 acres of land that was illegally subdivided into 7 tracts of varying size by an heir to the original landowner. Mrs. Simmons received a tract of land that is just over 3 acres. Until recently, there was a mobile home on the applicants' property. The owners removed the dilapidated mobile home and had plans to replace it with a newer manufactured home. When the applicants attempted to obtain a permit to locate the new home on the property, they were denied because the land was not legally subdivided and the current configuration of the lot was smaller than the 5 acre minimum allowed by the A -O zoning district. The current A -OX zoning district allows for a minimum lot size of 2 acres. Several attempts have been made in the past to get the different owners of the tracts together for legal subdivision, without success. The final plat is the last step in the process to be able to place the mobile home on the property. Related Advisory Board Recommendations: This property went before the Parks Board at the November 12, 2002 meeting. Commission Action Options: The Commission has final authority over the final plat. The options regarding the final plat are: 1. Approval as submitted; 2. Denial. Supporting Materials: 1. Location Map 2. Application 3. Infrastructure and Facilities 4. Copy of Final Plat INFRASTRUCTURE AND FACILITIES Water required for plat: No Water Service: The City does not currently have a water main in the area. An OSSF is allowable on the subject property Streets /Access: Barron Cut -off Road is not classified on the Thoroughfare Plan. Additional ROW is being dedicated with the plat. Drainage: N/A Flood Plain: The subject property is not impacted by floodplain. Oversize request: None Impact Fees: The subject property is within the 97 -01 Sewer Impact fee area. The impact fee is assessed at final plat.
