SUBJECT: VARIANCE REQUEST AND REPLAT for FS KAPCHINSKI
Item: Public hearing, discussion, and possible action on a Variance Request to Section
18 of the Subdivision Regulations and a Replat for FS Kapchinski consisting of 2 lots on
0.9 acres generally located at 1609 Park Place.
Applicant: Kerr Surveying, Agent
Staff Recommendations: Staff recommends approval of the Replat conditioned on the
approval of the variance request.
Item Summary: This item is firstly, the consideration of a variance request to Section
18, Platting and Replatting Within Older Residential Subdivisions. The regulation is
applicable to subdivisions platted prior to July 15, 1970. The Regulations state:
18 -B. In addition to the other provisions of this ordinance, no plat, replat, vacating and
resubdividing plat or other plat intended to provide for the resubdivision of an existing lot
or lots in a residential subdivision may be approved unless:
18 -B.1 The plat does not create an additional lot or building plot.
18 -B.2 A plat which does create an additional lot or building plot must meet or
exceed the average width of the lots along the street frontage, for all lots
in the block and contain at least 8,500 square feet of space for each
dwelling unit.
The 2 lots created by this plat exceed the 8,500 sqft minimum. The average width of the lots in
the block has been determined to be 62 -ft. The Applicant is seeking to plat two lots each with a
width of 54 -ft. A variance is therefore required (see Section 5A Variances below). The newly
created lots would exceed the required 50 -ft minimum lot width for R -1 zoning.
This area has recently seen new development activity. Lot width variances have been granted
by the Commission in this area in the recent past; specifically the adjacent lots to the west.
The Commission must first rule on the variance request. If approved, the Commission can vote
on the approval of the plat.
Comprehensive Plan Considerations:
Land Use Plan: Single- family, residential
Thoroughfare Plan: Park Place is a residential street
Parkland Dedication: Fee in lieu of land. The fee is currently $556 per lot. One lot is
existing. The fee is due on one newly created lot.
Open Space Dedication: None

SECTION 5: VARIANCES
5-A The Commission may authorize a variance from the regulation when, in their opinion, undue
hardship will result from requiring strict compliance. In granting a variance, the Commission shall
prescribe only conditions that it deems not prejudicial to the public interest. In making the findings
hereinbefore required, the Commission shall take into account the nature of the proposed use of
the land involved, the existing use of land in the vicinity, the number of persons who will reside or
work in the proposed subdivision, the possibility that a nuisance will be created, and the probable
effect of such variance upon traffic conditions and upon public health, convenience, and welfare of
the vicinity. No variance shall be granted unless the Commission finds:
5 -A.1 That there are special circumstances or conditions affecting the land involved such that
strict application of the provisions of this chapter will deprive the applicant of the
reasonable use of his land;
5 -A.2 That the variance is necessary for the preservation and enjoyment of a substantial
property right of the applicant;
5 -A.3 That the granting of the variance will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the City in administering this
chapter; and
5 -A.4 That the granting of the variance will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with the provisions of this chapter.
55 = 8 Such findings of the Commission, together with the specific facts upon which such findings are
based, shall be incorporated into the official minutes of the meetings at which such variance is
granted. Variances may be granted only when in harmony with the general purpose and intent of
this chapter so that public health, safety, and welfare may be secured and substantial justice
done.

SUBJECT: FS KAPCHINSKI (FP) - Final Plat
Staff reviewed the above - mentioned final plat as requested. The following page is a list
of staff review comments detailing items that need to be addressed. If all comments
have been addressed and the following information submitted by Monday, October 6,
10:00 a.m., your project will be placed on the next available Planning and Zoning
Commission meeting scheduled for, October 16, 2003, 7:00 p.m. in the City Hall Council
Chambers, 1101 Texas Avenue.
$100 Variance Request fee;
Two (2) copies of the revised final plat;
Parkland Dedication in the amount of $556 must be submitted prior to the
filing of the final plat;
One (1) Mylar original of the revised final plat; and
One (1) copy of the digital file of the final plat on diskette or e-mail to
nmanhart @ci.college - station.tx. us
Upon receipt of the required documents for the Planning & Zoning meeting, your project
will be considered formally filed with the City of College Station. Please note that if all
comments have not been addressed your project will not be scheduled for a Planning &
Zoning Commission meeting. Your project may be placed on a future agenda once all
the revisions have been made and the appropriate fees paid. If you have any questions

ENGINEERING
1. Please show the Original Plat as it was originally platted.
2. Please show the Replat with all existing information. Future Lot 3A is now Lot 3A,
etc.
3. Include acreage of lot in title block.
4. Tie -down subdivision to know reference point.
5. General Note 2: Setbacks are per the UDO.
6. You will need an exhibit to demonstrate lot width determination to show exactly how
much of a variance is being requested.
7. You will also need a letter addressing the justifications for the variance to be
included with the other P &Z information. Please see Section 5 of the Subdivision
Regulations.
8. Bottom note should read: Note: This property will be considered one building plot
until existing structures are removed or destroyed.

ELECTRICAL
1. Developer installs conduit per city specs and design.
2. Developer provides 30' of #4 rigid conduit for riser poles. Developer installs
first 10'. City installs remainder.
