Question 7 concerning and easement on this site is in error. We examined the deed referred to in Volume 2615 Page 160 refers only to the Pittman Tract and not to Spring Meadows tract. ENGINEERING Per our discussion with you and your comments related to the subdivision have been made and are included in the plans attached. Concerning the very minor filling on some of the lots we have previously submitted to you the FEMA document and filing fees. We will note that nothing has changed in this regard from our previous approval. We further state that there will be no effect on the floodplain elevation, in fact the detention and landscaped yards will have an effect which will likely lower the floodplain elevation. Both the filling and potential positive effects will be below reasonably measurable levels. Question 3 concerning the storm sewer grate we discussed with you and our solution to that was to grade any off -site drainage away from this inlet to an existing natural drainage course. The storm sewer grate will now only receive water from the back portion of a few of the lots. If you have any questions please contact me. In granting a variance, the Commission shall prescribe only conditions that it deems not prejudicial to the public interest. In making the findings hereinbefore required, the Commission shall take into account the nature of the proposed use of the land involved, the existing use of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, the possibility that a nuisance will be created, and the probable effect of such variance upon traffic conditions and upon public health, convenience, and welfare of the vicinity. No variance shall be granted unless the Commission finds: 5 -A.1 That there are special circumstances or conditions affecting the land involved such that strict application of the provisions of this chapter will deprive the applicant of the reasonable use of his land; 5 -A.2 That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant; ,. 5 -A.3 That the granting of the variance will not be detrimental to the public health, safety, or r. o welfare, or injurious to other property in the area, or to the City in administering this chapter; and 5 -A.4 subdivision of other land in variance will not have the effect area in accordance with the provisions orderly ns of this preventing chapter. 55 = B Such findings of the Commission, together with the specific facts upon which such findings are based, shall be incorporated into the official minutes of the meetings at which such variance is granted. Variances may be granted only when in harmony with the general purpose and intent of this chapter so that public health, safety, and welfare may be secured and substantial justice done. (Ordinance No. 2179 of May 9, 1996) 5_C Appeals (Note: This section was deleted in its entirety by Ordinance No. 2386 of April 22, 1999) . 9 -5 Rev. 7/02 Notes for Local Officials Professional Certification As required by state and local floodplain management ordinances, a proposed development must be determined to be reasonably safe from flooding. The official having the authority to make this determination should require all appropriate information for making the determination. This may include a certification by a qualified design professional ihat indicates the land or structures to be removed from the SFHA are reasonably safe from flooding, according to the criteria described in this technical bulletin. Such a professional certification may come from a professional engineer, professional geologist, professional soil scientist, or other design professional qualified to make such evaluations. A sample of such a certification is shown in Figure 1.
