EASEMENT AMENDMENT
This Easement Amendment is made this "day of October, 2002, by and
between KTH Investments, a Texas general partnership ( "KTH ") and Korean Mission
Church of Texas A &M, a Texas nonprofit corporation ( "Church ").
RECITALS
A. KTH was originally the owner of Lots One (1) and (2), Block One (1),
K.T.H., COMMERCIAL ADDITION, an addition to the City of College Station, Brazos
County, Texas, according to the Plat (the "Plat ") recorded in Volume 4377, Page 206, of
the Official Records of Brazos County, Texas; and
B. On December 13, 2001 by deed recorded in the Official Records of
Brazos County, Texas, KTH conveyed to the Church: (a) Lot Two (2), Block One (1),
K.T.H., COMMERCIAL ADDITION, an addition to the City of College Station, Brazos
County, Texas, according to the Plat recorded in Volume 4377, Page 206, of the Official
Records of Brazos County, Texas ( "Lot 2 "); and (b) a perpetual fifty foot (50') access
easement (the "Access Easement Area ") across the front of Lot Two (2), Block One (1),
K.T.H., COMMERCIAL ADDITION, an addition to the City of College Station, Brazos
County, Texas, according to the Plat recorded in Volume 4377, Page 206, of the Official
Records of Brazos County, Texas.
C. The parties wish to allow parking within the Access Easement Area.
NOW THEREFORE, for good and valuable consideration and the mutual
promises contained herein, the parties hereby agree as follows:
1. In addition to the right to use the Access Easement Area for pedestrian
and vehicular ingress to and egress from Lot 2 and the Highway 6 Frontage Road, the
Church shall have the right to construct and use and the obligation to maintain up to
nineteen parking spaces in the Access Easement Area for the benefit of Lot 2.
2. It is hereby agreed and stipulated that Lot 1 and Lot 2 shall be held,
transferred, improved, sold, conveyed, used, and occupied subject to the foregoing
covenants and agreements which shall be covenants running with and binding upon Lot
1 and Lot 2.
3. This agreement shall not be construed more or less favorably among the
parties by reason of authorship or origin of language.
