Here's my take on it now. Once Benito pointed out the oversight we went back and looked at the structure. It was inconclusive at the time whether the structure was acutally over 50 years or not due to some of the materials that were found in it. So the project continued forward. see this porch enclosure as a continuation of the project already approved by Council. The Zoning ordinance section seems moot at best. We assume the PRC would ensure the air vents, being necessary for ventilation of the crawl space area under the building, are complimentary to the building's stone skirt facade and comply with the architectural design standards for the Northgate area. »> Molly Hitchcock 10/24/02 01:51PM »> Afternoon! ATTN: Mr. Don Ganter 3712 Old College Road Bryan, Texas 77801 -4109 RE: Satchel's / 303 Boyett — College Station, Texas Dear Mr. Ganter, My last correspondence with you regarding alterations to the above referenced restaurant was sent to you on August 8, 2002. I also spoke with you on the phone two days prior to that, and in that phone conversation you told roe you were considering enclosing the exterior porch. It has now been thirty-eight days since our initial conversation regarding the alterations to your building. This letter is to inform you that because of the alterations to, and unfinished state of repair of, the upper portions of the porch columns, you are currently in violation of the Terms and Conditions of your Facade Improvement Program loan agreement with the City. In that agreement, Number 9 of the Terms and Conditions states: "The Owner agrees not to allow any changes or additions to the plans and specifications in the Construction Contract without written approval of a change order approved by the City." Additionally in Number 12 (b) of the Terms and Conditions it states: "The Owner shall maintain the facade improvements at a similar or higher level or maintenance for a minimum of five years- Modifications to facade improvements must conform to appropriate architectural designs and building exteriors must be maintained in accordance with City building and anti - neglect standards." An executed copy of the Facade Improvement Program agreement is attached for your review. On August 21, 2002 at 8:30 AM in room 103 of the College Station Conference Center, there was a special called Facade Improvement Program Advisory Committee meeting for you to submit the proposed changes of your building to the committee for review. I called this meeting to try and expedite the review process so you could commence with the alterations as soon as possible. You may recall, I contacted your office (via phone) on two separate occasions the week prior to the meeting. On the first call I spoke to you personally and asked if you could be at the meeting to present drawings of your proposed building alterations to the committee and gave you the tentative time, date and place of the meeting. You confirmed that you would be there along with your supporting materials. The second time I called I left a message for you with an employee at your office, confirming the date, , time, receive a l a call with information had presented it to you earlier. You did not attend that meeting that you would not be in attendance.
