NON - HOMESTEAD PRIVATE PROPERTY

BEFORE ME, the undersigned authority, personally appeared Lamar Dunn, who upon
his/her oath, deposed and stated the following:
1. My name is Lamar Dunn and I am a resident of McLennan County, Texas. 1 am
the Accounts Receivable Coordinator, hereinafter sometimes referred to as "Claimant." I am
over 18 years of age, and am competent and authorized to make this affidavit.
2. Claimant's mailing business address is P.O. Box 11009, Waco, TX 76716 and
Claimant's physical address is 574 Youngblood Road, Waco, TX 76706.
3. Claimant furnished labor and materials for improvements to the real property
described herein under a contract by and between Claimant and EMERSON CONSTRUCTION,
whose last known address is PO BOX 1888 TEMPLE, TX 76503.
4. The name of the owner or reputed owner of the real estate hereinafter described
is WAL -MART REAL ESTATE BUSINESS TRUST ATTN: WAL -MART PROPERTY TAX
DEPT, whose last known address PO BOX 8050 BENTONVILLE, AR 72712 -8055.
5. The labor, materials, and work furnished by Claimant are generally described as
follows: Contract for Roof on Property.
6. The real property sought to be charged with a lien by Claimant is described as
follows: 1815 BROTHERS BLVD COLLEGE STATION, TX 77845
7. After allowing all just credits, offsets, and payments, the amount of
$231,215.85 remains unpaid and is due and owing to Claimant under its contract with
EMERSON CONSTRUCTION PO BOX 1888 TEMPLE, TX 76503, and Claimant, claims a lien
on said property and improvements under the provisions of Texas Property Code § 53.001 et seq.
to secure payment of said amount.
