§ AFFIDAVIT FOR MECHANIC'S
COUNTY OF HARRIS § AND MATERIALMANS' LEN
BEFORE ME, the undersigned authority, personally appeared Rhonda Wilson, Senior
Credit Manager, who upon her oath deposed and stated the following:
1. My name is Rhonda Wilson. I am the Senior Credit Manager for and designated
agent of ACT Pipe & Supply, herein sometimes referred to as "Claimant" or
"ACT". I have personal knowledge of the facts set forth below and am authorized
to make this affidavit on its behalf as the sworn statement of claim.
2. Claimant's business address is 6950 West Sam Houston Parkway North, Houston,
Texas 77041.
3. Pursuant to an agreement by and between Claimant and Brazos Valley Services,
whose last known address is Post Office Box 985, Bryan, Texas 77806, Claimant
performed labor, furnished material and equipment to improve the following
described real property in Brazos County, Texas:
Project: Wal -Mart Supercenter #110508, 1815 Brothers Boulevard, College
Station, Texas aka Southwood Plaza Ph 1, Block 15, Lot 3, Brazos
County, Texas
4. The labor, materials, and work furnished by Claimant are generally described as:
Plumbing supplies, valves, piping, supplies, fixtures, labor, supplies and/or related
materials. The work and materials were provided to the project during the months
of September 2009 through January 2010.
5. The owner or reputed owner of the above - described real property is:
Wal -Mart Stores of Texas LLC
Post Office Box 8050
Bentonville, Arkansas 72712
and/or
Walmart Stores, Inc.
702 SW 8 Street
Bentonville, Arkansas 72716 -8611
and /or
Wal -Mart Real Estate Business Trust
Attn: Wal -Mart Property Tax Dept.
Post Office Box 8050
Bentonville, Arkansas 72712 -8055

6. The original contractor for the improvements for which a lien is claimed is
Emerson Construction Company whose last known address is Post Office Box
1888, Temple, Texas 76503.
7. After allowing all just credits, offsets, and payments, the amount of $16,401.32 is
unpaid and is due and owing to Claimant under said account and ACT, Claimant,
claims a lien on said property, and improvements to secure payment of said
amount,
8. Claimant sent notices to the Owner, and General Contractor by certified mail,
return receipt requested on November 9, 2009, November 19, 2009, January 5,
2010, January 27, 2010 and February 25, 2010, and sent an additional notice by
certified mail, return receipt requested along with the filing of this affidavit.
Claimant also claims a lien against all the above described property, and improvements
thereon in the amount shown above, pursuant to Chapter 53 of the Property Code of the State of
Texas, and makes this sworn statement of claim in support thereof.
