Coe, President, Bryan Radio & TV Service, Inc., 4105 Tanglewood Drive, Bryan, TX 77801 From: Bridgette George, Assistant Development Manager Subject: BRYAN RADIO & TV SERVICE DRIVEWAY PERMIT (02- 00500199) Staff reviewed your request for a driveway permit for the aforementioned project, but has denied the request due to the proposed driveway violating a City ordinance. Please review the attached staff review comments and contact Brett McCully or myself if you have any further questions. Home of Texas A &M University ENGINEERING REVIEW COMMENTS No. 1 1. This driveway permit has been denied. The proposed driveway violates the Driveway Access Location and Design Policy ordinance and presents safety concerns due to location and traffic along Texas Avenue. The portion of the Ordinance, H. (4).(c) that you referenced and addresses corner clearance is for properties that have no other access. Your access to Holleman precludes consideration under this section. According to the Driveway Ordinance, you may appeal the City Engineer's decision. Please read the following: (9) Appeals (a) Appeals of the terms of this section or of decisions of the City Engineer shall be heard by the Project Review Committee as defined in Section 10, Ordinance 1628, the Zoning Ordinance for the City of College Station, Texas. (b) An appeal shall be made within thirty (30) days of the date of the notification of the decision by filing with the City Engineer a notice of appeal specifying the grounds thereof. The City Engineer shall forthwith transmit to the Project Review Committee all the papers constituting the record upon which the action appealed from was taken. (c) The Project Review Committee may authorize on appeal a variance to the Driveway Access Location and Design Ordinance when such variance will not be contrary to the public interest where, owing to unique and special conditions not normally found in like areas, a strict enforcement of the provisions of the ordinance by the City Engineer would result in an unnecessary hardship, and so that the spirit of this ordinance shall be observed and substantial justice done.
