Subject: 303 WALTON DRIVEWAY ACCESS PERMIT (02- 00500198)
Staff reviewed your request for a driveway permit for the aforementioned
project, but has denied the request due to the proposed driveway violating the
City's Subdivision Regulations. Please review the attached staff review comments
and contact Brett McCully or myself if you have any further questions.

COMMENTS No. 1
This permit to construct access driveway facilities on Lincoln Avenue is denied.
The proposed driveway violates Subdivision Regulations that restrict residential lot
access to collectors. Lincoln Avenue is classified as a major collector. Chapter 9,
Section 8 -G.8 of the Ordinance states:
The Planning Commission may require that, where practical, residential Tots
adjacent to arterial and collector be platted or restricted so as to prevent
driveways opening into such streets.
The property already has adequate access from Walton and a right -of -way that
abuts the rear of the property. If you need obstructions removed from said right -
of way, please contact Mark Smith with City of College Station Public Works at
(979)764 -3690.
You may appeal the City Engineer's decision. Please read the following:
(9) Appeals
(a) Appeals of the terms of this section or of decisions of the City Engineer shall
be heard by the Project Review Committee as defined in Section 10, Ordinance
1628, the Zoning Ordinance for the City of College Station, Texas.
(b) An appeal shall be made within thirty (30) days of the date of the notification
of the decision by filing with the City Engineer a notice of appeal specifying the
grounds thereof. The City Engineer shall forthwith transmit to the Project Review
Committee all the papers constituting the record upon which the action appealed
from was taken.
(c) The Project Review Committee may authorize on appeal a variance to the
Driveway Access Location and Design Ordinance when such variance will not be
contrary to the public interest where, owing to unique and special conditions not
normally found in like areas, a strict enforcement of the provisions of the
ordinance by the City Engineer would result in an unnecessary hardship, and so that
the spirit of this ordinance shall be observed and substantial justice done.
