STAFF REPORT Project Manager: Jennifer Flanery Date: September 9, 2002 Email: jflanery@ci.college- station.tx.us Item: Public hearing, discussion, and possible action on a Conditional Use Permit, use & site for the Parkway Baptist Church (CUP) located at 1501 Southwest Parkway. (02 -176) Applicant: Steve Duncan Staff Recommendation: Staff recommends approval of the site plan as submitted. Item Summary: The purpose of the Conditional Use Permit application is to expand the existing facilities at the Parkway Baptist Church by adding a new Worship Hall and three temporary portable buildings for classrooms to the site. The portable classrooms will be in place until the new worship hall is completed. When the portable buildings are removed, the area will be the site of the new playground. The existing worship building will be used for administrative purposes and minor work to the eastern facade is proposed. An additional portable building will be added in the rear of the main buildings for storage. The facilities are intended to be used weekdays and weekends during the day and evenings for various church related activities. There is no buffer requirement for churches, however, the subject property currently has a natural buffer around most of the site. The adjacent duplex to the east is owned and used by Parkway Baptist church as a youth education building. Residential zoning districts do not generally permit commercial type signage, however signs are usually reviewed at the time of site plan approval with the Conditional Use process. The proposed sign for the church will be 4.5 -ft. in height and 12 -ft. in length for a total of 54 square -ft. in area. This meets the city's requirement for a commercial freestanding sign. Comprehensive Plan Considerations: The subject property is zoned R -6, Apartment High Density. The Land Use Plan shows this area as Institutional, so the request is in compliance with the Land Use Plan. Parkway Baptist Church has frontage on and access to Southwest Parkway, a minor arterial on the Thoroughfare Plan. The property to the east is zoned R -6 and is developed as duplexes. The property to the north is zoned R -3 and is developed as single - family homes. The property to the west is zoned R -1 single family residential and is developed as Lemon Tree Park. Item Background: The subject property was annexed into the City in 1969 and was platted for the development of a church in 1976. In 1977 the Commission granted a Conditional Use Permit for a church. Another Conditional Use Permit was granted in 1995 for the use of an adjacent duplex unit as a youth education building with the stipulation that no vehicular access could be taken from the duplex to the church site. Staff Analysis: Section 14 of the Zoning Ordinance authorizes the existence of conditional uses. The Commission may permit a conditional use subject to appropriate conditions and safeguards, when after public notice and hearing the Commission finds that: (Staff comments are in italics) 1. "The proposed use meets all the minimum standards established in the ordinance for the type of use proposed." Staff conducted a technical review and found general compliance with development regulations. 2. "That the proposed use meets the purposed and intent of the ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City. The request is in compliance with the Comprehensive Plan. 3. "That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property." The public hearing is an opportunity for the Commission to measure the potential impact on surrounding land uses. The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements may include, but are not limited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening." Unless the public hearing bring to light any new information indicating potential negative impacts, Staff recommends approval with Staff Review Comments. Commission Action Options: The Commission has final authority over the Conditional Use Permit and associated site plan. The options regarding the use permit are: 1. Approval as submitted; 2. Approval with conditions relating to specific site characteristics or with time limitations; 3. Denial with specified reasons for denial; 4. Table; or, 5. Defer action to a specified date. Copy of Site Plan INFRASTRUCTURE AND FACILITIES Water: There is an existing 12" water main across Southwest Parkway. The Church will bore the road and take a 6" fire line to the new structure. Sewer: There is an existing 10" sewer main in front of the property. Streets: Southwest Parkway is classified as a minor arterial on the Thoroughfare Plan. Off -site Easements: None. Drainage: Drainage of this property is directly to Bee Creek. The site is permitted to discharge directly to the main channel. Measures will be taken to assure erosion control on Park Property. Flood Plain: A large portion of the rear of the property is within the 100 - year floodplain. The new structure will be constructed above the base flood elevation. Oversize request: None. Impact Fees: None.
