Re: Edelweiss Gartens, Phase 5 - Oversize Participation Request
Dear Brett:
We are in the process of developing construction plans for Edelweiss Gartens,
Phase 5. The sewer system for this phase involves the extension of a sewer outfall that
presently terminates south of the Westfield Addition. From previous discussions we
understand that the City wishes to oversize the sewer outfall so that it will accommodate
all of the sewer basin south and west of Edelweiss Gartens.
With that understanding, I have prepared the attached exhibit that shows an
analysis of the line sizes needed to accommodate the remaining two phases of Edelweiss
Gartens. The analysis indicates that a 6" diameter line is sufficient, but I've assumed it to
be 8" diameter for purposes of estimating oversize participation costs. The second
analysis on the exhibit adds the additional land in the sewer basin outside of Edelweiss
Gartens. It indicates that the 15" trunk line should be extended a short distance, then
reduced to a 12" and later a 10" line.
Before the construction plans are completed, we need a commitment from the
City of College Station that it is willing to pay the cost of oversizing the sewer line. I
have included an estimate of the oversize participation costs for your use. I ask that you
forward this request through the appropriate channels for consideration so that we can
fmish our design accordingly. Thank you.

Dear Brett:
Attached is the map exhibit you requested associated with the Oversize Participation
request for Edelweiss Gartens, Phase 5. The sewer service area for this system is
everything within the dashed red lines
Also enclosed is a slightly revised spreadsheet analysis in which I've added a few
additional lots in Westfield, Phase 4 and about 3 acres in the undeveloped tract adjacent
to Wellborn Road. These adjustments account for areas that could potentially be served
by this system, but their impacts are minimal and do not change the line sizes or costs
from the previous submittal. Please call if you have questions.

City Staff has evaluated your request for OP as outlined in your letters
dated 03/12/03 and 03/21/03. The following comments are being returned
to you:
• The request for OP by the Westfield Development for increased fine size
from an 8" line to a 15" line (FF -EE) appears to be in compliance with
ordinance.
• The request for OP by the Westfield Development for increased line size
from an 8" line to a 12" line (EE- Victoria) appears to be in compliance

Re: Edelweiss Gartens Subdivision
Dear Mr Templin:
The developers of Edelweiss Gartens Subdivision request a variance to Section 8 -J.2 of
the Subdivision Ordinance. This section of the ordinance states:
Block length shall not exceed one thousand two hundred feet (1,200) in single -
family residential areas and shall not exceed eight hundred feet (800) in other
areas. In blocks over eight hundred feet (800) in length, there may be required,
near the center of the block an access way as hereafter defined. An access way
may be required at the end of a cul -de -sac to facilitate pedestrian traffic
movement.
The section of Edelweiss Gartens in question is referred to as Phase 4, which borders the
subdivision on the northwest and west sides of the tract. It is currently planned for duplex
development. The developers believe this is the best use for this portion of the subdivision
because it lies adjacent to commercial property on the north and future TxDOT right -of -way (SH
40) on the west. These adjacent land uses render Phase 4 as less desirable for single- family
development, but still marketable as duplex development if properly isolated from adjoining
phases of the subdivision.
The property is being forced into an unusual circumstance because of the right -of -way
acquisition that is anticipated by TxDOT on the west side of Phase 4. TxDOT officials have
indicated that no access to SH 40 will be allowed in the area where this property lies. The
developer is attempting to accommodate TxDOT's future plans, but in doing so he is not able to
comply with this section of the ordinance. The block length as shown on the Preliminary Plat is
approximately 2100 feet long. A temporary access driveway to Wellborn Road is provided about
the 1250 feet from the entrance until SH 40 is constructed.
In order to approve a variance, the Planning and Zoning Commission must find that each of
the following conditions exist:
1. That there are special circumstances or conditions affecting the land involved such that strict
application of the provisions of this chapter will deprive the applicant of the reasonable use of
this land;
Response: The land to the north and west of Phase 4 is either developed commercial
property or unavailable for use because it falls in future ROW of SH 40. No access to these
adjoining properties is available to the developer. Access into adjacent phases of single -

family development is not advisable here because it would no longer provide the separation
of incompatible land uses.
2. That the variance is necessary for the preservation and enjoyment of a substantial property
right of the applicant;
Response: The developer is attempting to provide a gradation of land uses that separates a
major arterial (SH 40) and the single-family residential areas in Edelweiss Gartens. Because
the developer is attempting to accommodate TxDOT's plans for the roadway, there are no
other reasonable options available for access to this portion of the subdivision.
3. That the granting of the variance will not be detrimental to the public health, safety, or
welfare, or injurious to other property in the area, or to the city in administering this chapter;
Response: Phase 4 of the subdivision does not pose a detriment to public health, safety or
welfare. There are no flood prone areas that would need emergency evacuation and all city
services will still be available. A turn - around at the end of the street will be provided for
emergency vehicle in the same way that normal cul -de -sacs are designed. Future extension
of the street to the south will eliminate this turn- around when that property develops.
Adjoining property of the north, west, and east sides are unaffected.
4. That the granting of the variance will not have the effect of preventing the orderly subdivision
of other land in the area in accordance with the provisions of this chapter.
Response: The only developable tract of land in the area that is not already part of this
subdivision lies to the south of Phase 4. This variance will in no way preclude the
development of that tract. The owner of that tract has been contacted and advised of the
development plans in Edelweiss Gartens. He has indicated it is compatible with future plans
he has for his tract.
Please forward this request to the Planning and Zoning Commission for consideration.
