Requested variance to subdivision regulations and reason for same (if
applicable):
A. Variance for Lots 16 -4R and 16 -5R having a minimum lot width (112.00') less
than the calculated average lot width of 117.33' per UDO Article 8.2 -A-
11.b(2)(b).
1. That there are special circumstances or conditions affecting the land involved such
that strict application of the provisions of this chapter will deprive the applicant of
the reasonable use of his land;
A large two -story structure exist on Lot 16 -3 that restricts the even distribution of
three lots through the entire 2.20 acre tract.
2. That the variance is necessary for the preservation and enjoyment of a substantial
property right of the applicant;
The granting of this variance will allow the developer the ability to develop this lot
with two new single - family residential lots (lot width of 112.00') in a nature
consistent with the surrounding neighborhood. Excluding this large tract the average
lot width frontage, for this block, is calculated to be 112.40'. This is extremely close
to the proposed lot width of Lots 16 -R4 and 16 -R5.
3. That the granting of the variance will not be detrimental to the public health, safety,
or welfare, or injurious to other property in the area, or to the City in administering
this chapter;
The grating of this variance will not be detrimental to the public health, safety, or
welfare. The proposed development is consistent with existing adjacent
developments.
4. That the granting of the variance will not have the effect of preventing the orderly
subdivision of other land in the area in accordance with the provisions of this
chapter.
No adverse impacts to future developments are perceived with the granting of this
variance. Much of the neighboring property is developed in the same nature that this
replat is proposing.
