Item: Public hearing, discussion, and possible action on a Conditional Use
Permit for the Time Square Night Club located at 226 Southwest Parkway.
Applicant: Johnny Oates, Partner LDLE, L.P.
Staff Recommendation: The subject property meets the minimum standards
established in the Unified Development Ordinance. Unless the public hearing
brings to light any new information indicating potential negative impacts, Staff
recommends approval of this request.
Item Summary: The subject property consists of 3.43 acres that is currently
zoned C -1 General Commercial. The existing building has been vacant for
approximately two years. The property is abutted and developed by R -2 Duplex
Residential and A -P Administrative Professional. To the north and west the
property is C -1 General Commercial developed as restaurant/bar, as well as a
retail shopping center. To the south is developed R -7 Manufactured Home Park.
In the -mid 1980's, the subject property was originally developed as the Schulman
Movie Theater. In 1993 the City Council approved a Conditional Use Permit for a
nightclub (The Globe) with the condition that the club have an annual review
before the Planning and Zoning Commission. The club was closed prior to
meeting that condition for annual review. In 1995 there was a Conditional Use
Permit granted for the Pallazzo Theater, which was never opened. In 1997 the
Commission approved a Conditional Use Permit for a Billiards Pool Parlor (Side
Pockets /Rack Warehouse). In 2000 the Rack Warehouse came back before the
Commission to ask permission to add a dance floor, which was approved.
Comprehensive Plan Considerations: The Land Use Plan designates this area
as Retail Regional. The nightclub has access to and from Southwest Parkway (a
minor arterial) and Texas Avenue (a major arterial).
Item Background: The subject property is currently platted and was annexed
into the City of College Station City Limits May of 1969.

Commission Action Options: The Commission has final authority over the
Conditional Use Permit and associated site plan. The options regarding the use
permit are:
1. Approval as submitted;
2. Approval with conditions relating to specific site characteristics or with time
limitations;
3. Denial with specified reasons for denial;
4. Table; or,
5. Defer action to a specified date.
