My boss and I were talking about it again this morning and both felt that we had over looked something. We looked in the Texas Local Government Code and it specifically states that an Amending Plat is allowed "to relocate a lot line to eliminate an inadvertent encroachment of a building or other improvement on a lot or easement." Since this is what you and your mother are trying to do, this would be the best way to proceed. Then, since you are only required to do an Amending Plat, side walks would not be required along Luther, but we would still require right -of -way dedication. This also means that this plat will not have to go to the Planning and Zoning Commission and can be approved at staff level.
