THIS IS TO CERTIFY: That we have examined the records of the County Clerk of Brazos County, Texas as they
are reflected in the geographically indexed title plant of University Title Company as to the following property, to-
wit:
Tract One: Fee Simple
Lot Nine R-One (9R-1), Block One (1~ The Gateway Subdivision, Phase 1, City of College Station,
according to replat thereof recorded in Volume 9058, Page 70 of the Official Records of Brazos
County, Texas.
Tract Two: Easement
Access Easement benefiting Tract One (1) as set forth in the certain Decelaration of Easement
dated April 1, 1999, executed by Delmar Baronheard I, Ltd., filed for record July 16, 1999, and
recorded in Volume 3542, Page 324, and as set forth outhat certain Plat entitled "A Final Plat of
The Gateway" recorded in Volume 3663, Page 00313, Deed Records, Brazos County, Texas, and
being further described as follows:
Metes and bounds description of all that certain 0.587 acre tract or parcel of land, lying and being
situated in the Richard Carter League, Abstract No. 8, College Station, Brazos County, Texas,
being a 64' wide private access easement, and being a portion of proposed Lots 1, 4, and 5, The
Gateway, Phase I as depicted on the final plat of said proposed subdivision, and being a portion out
of that same tract conveyed to Delmar Baronhead I, Ltd., as described by deed recorded in Volume
3046, Page 100, of the Official Records of Brazos County, Texas, said 0587 acre tract being more
particularly described as follows:
COMMENCING at a 1-1/2" x 1" iron bar found marking the south corner of that same 1.15 acre
tract conveyed to Bert Wheelers, Inc., as described by deed recorded in Volume 391, Page 864 of
the Deed Records of Brazos County, Texas, and lying in the northwest right-of-way line of
University Drive East;
THENCE S 50049128" W - 24.82 feet with said right-of-way line to a 1/2" iron rod found for angle
point;
THENCE S 55°04'50" W - 315.34 feet with said right-of-way line to a point for the PLACE OF
BEGINNING;
THENCE S 55004150" W - 32.01 feet with said right-of-way line to a point for the common south
corner between said Lot 4 and said Lot 5;
THENCE S 55004150" W - 32.01 feet with said right-of-way line to a point for corner;
THENCE N 33°53'03" W - 245.37 feet across said proposed Lot 5 to a point for corner;
THENCE N 58054148" W -146.41 feet across said proposed Lot 1 to a point for corner;
THENCE N 41059158" E - 65.18 feet to a point for corner;
THENCE S 58054'48" E -148.28 feet across said proposed Lot I to a point for corner;
THENCE S 33053'03" E - 258.42 feet across said proposed Lot 4 to the PLACE OF BEGINNING,
and containing 0.587 acres of land.

Declaration of Easement, dated January 1, 1998, from Delmar Baronhead I, Ltd., to The Public,
recorded in Volume 3252, Page 212 and amended on November 18, 2002, recorded in Volume 5239,
