McClure Engineering Inc. 1008 Woodcreek Drive Suite 103 College Station, TX 77845 Re: Westfield Village Phase 6 Turnaround Requirements Dear Mike, This letter should serve as response to your e-mail dated July 7, 2003, a copy of which is attached for reference. In March of this year, a preliminary plat was submitted for Phase 6 of Westfield Village. This plat included Victoria Avenue and Mountain Breeze Way across the length of the project, as well as the intersection of these two boundary streets. This submittal was subject to a stop review due to non - compliance with the zoning of the property. While Ordinance Chapter 9, Section 6 -B.2.1 requires that subsequent phases of a master preliminary plat may only be developed if adjacent to each other, Staff believed that the connection to the north via Victoria Avenue provided sufficient traffic access for the project. After the project was rezoned, a revised preliminary plat was submitted in June that no longer included Mountain Breeze, and only included Victoria Avenue up to the curb return points of the intersection with Mountain Breeze. Rather than reject the roadways as dead -ends, staff interpreted that temporary turnarounds on Victoria Avenue and Night Rain Drive would effectively make them temporary cul -de -sacs to avoid the dead -end street prohibition requirement. As in all such requirements, applicants have the option of modifying their proposal in any number of ways to address the issue, or to request a variance from the P &Z. As you are well aware, we are able to take variance requests to the same meetings as the preliminary plats to avoid time delays, and have done so for you and your clients on other occasions. I believe your options in this Home of Texas A &M University Home of the George Bush Presidential Library and Museum specific case were to provide backing /turning maneuver areas within your plat, to • provide such areas outside of the plat boundary (with owners permission), to re- connect all or part of Mountain Breeze Way to eliminate the dead end conditions, or to seek a variance. Within your e -mail of July 7, you stated "...we must reluctantly comply with your demand for temporary turnarounds on Night Rain Drive and Victoria Avenue." This statement, along with the July submittal of a revised preliminary plat that included offsite, cul -de -sac style turnarounds advises me that while you disagree with the requirement, you have agreed to meet it. The plat therefore is moving forward in compliance with the ordinance, therefore no variance is needed. Next in your e -mail, you question the definition of the 'short stub' as included within the ordinance section itself. This section is applied as approximately 100 feet to be consistent with the alley and fire lane ordinance requirements. Ordinance Chapter 9, Section 6 -H.4 requires that dead end alleys may not be longer than 100 feet. Ordinance Chapter 6, Section 602.6.7 requires that fire lanes longer than 100 feet must connect with another means of egress or be provided with a turn around. The two streets proposed to be dead ends would have been approximately 470 feet and 680 feet, both far beyond any interpretive stretch of a 'short stub'. The next point in your e -mail is to question the discretionary status of when a turnaround is required. Clearly any permissive requirement (may) is defined to be permissive, and it should be obvious that anything 'required' is done so by the City upon the application. Therefore, depending on the nature of the actual specific proposal, Staff has the discretion to require a turnaround on the short stubs that area allowed. Due to the length of the dead end streets proposed, and the unknown period of time before connections or extensions are provided, Staff believes that it is in all parties interest to allow the streets with turnarounds (even temporary) rather than reject the dead end streets. The remainder of the e-mail appears to make the argument that this development is being singled out somehow, since you are aware of many other situations that do not seem to meet this requirement. The situations referenced in your e-mail, and others around the City, fall into two clear and distinct situations. The first is that some function of the development process, like the Bridalgate Development Agreement, has taken precedence over this requirement. In this manner, the applicant has effectively received a variance through a council approved document. The other situations are where the designer did not comply with the ordinance, and Staff did not catch the transgression. Please be reminded that our role is to review for compliance with standards, not to ensure them. Your own firm has submitted countless designs that complied with this requirement, many of which we specifically discussed this exact issue, as in Edelweiss Gartens. I am sure that there are others projects where the designs of many firms were not compliant, nor was our review complete enough to catch that omission, and thus they were built. Therefore it is my opinion that what you question as a lack of 'sound and uniform' discretion by City Staff, is in fact a lack of sound and uniform design by the submitting engineers coupled with sound and uniform enforcement by City Staff. As you are well aware, this City's development review staff is willing to meet with developers and engineers to discuss our requirements, and the various means of meeting them. We proved to you this past week, when even shorthanded I met with you and discussed alternate drainage provisions for Phase 5 of Edelweiss Gartens. Rather than submit a design that places 10 lots on a dead end street, and then protest our application of the ordinance due to life safety issues, why not ask ahead of time? I think it is safe to say that we do not see any subdivision submittals that are in 100% compliance with our requirements, including those sealed by yourself. I think it is also safe to say that we never will catch 100% of the items that are not compliant, including those reviews conducted personally by me. In closing, I would prefer to assume that you and your firm are doing your best and in the rush of our common business have overlooked something. In return, I ask that your assumptions be the same for us. I think in that way we can quickly resolve issues of fact and definition rather than trade accusations of inappropriate enforcement with unprofessional design.
