AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, PROVIDING FOR THE EXTENSION OF THE BOUNDARY LIMITS OF THE CITY OF COLLEGE STATION, ANNEXING CERTAIN TERRITORY ADJACENT TO THE PRESENT BOUNDARY LIMITS OF THE CITY OF COLLEGE STATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of College Station has the power by ordinance to fix the boundary limits of the City of College Station and to provide for the extension of such boundary limits and the annexation of additional territory lying adjacent to the City of College Station by the City Charter of the City of College Station, Texas, Section 7; and WHEREAS, on October 9, 2003, the City Council of the City of College Station granted a petition for annexation of approximately 6.843 acres; and WHEREAS, the City Council finds that all the required notices were given in the time and manner required by law; and WHEREAS, the City Council finds that the annexation will ensure consistent and orderly development of the annexed area; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: SECTION 1: The tract of land described in Exhibits A and B attached hereto and made a part of this ordinance for all purposes, are hereby added to and annexed to the City of College Station, Texas. SECTION 2: Should any part of this ordinance be held illegal or invalid for any reason, the holding shall not affect the remaining sections or portion of sections or provisions of this ordinance. If any part of the real property annexed in Exhibits A and B is already included within the City Limits of the City of College Station or is not within the City of College Station's jurisdiction to annex, the same is excluded from the territory annexed as fully as if the excluded area(s) were expressly excluded by this ordinance. SECTION 3: That upon final passage, approval and after the effective date of this ordinance, all property annexed shall be zoned AO (Agricultural Open Space). SECTION 4: That, upon final passage hereof and after the effective date of this ordinance, the annexed territory shall be a part of the City of College Station, Texas, and the property situated herein shall bear its pro rata portion of the taxes levied by the City of College Station and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions, and regulations of the City of College Station. o /group /legal /ordinances /boundary limits.doc HC.jls 10/14/02 Ordinance No. Page 2 SECTION 5: That this ordinance shall become effective after its passage and approval on October 9, 2003. The area requested for annexation, hereinafter referred to as "Area ", is described by metes and bounds in Exhibit A attached hereto and incorporated by reference. The Area is depicted in the plat attached hereto as Exhibit B. As the landowner, I represent that the approximate total acreage owned by is 2tacres. The annexation of the Area is initiated on written petition by me as owner. I represent that I am the landowner and that I am authorized to sign this Petition for Annexation. Further, I represent that this land is vacant and without residents (or that fewer than three qualifies voters reside on this property), is contiguous to College Station and the area is 1/2 mile or less in width. I understand that the governing body shall hear the petition and the arguments for and against the annexation and shall grant or refuse the petition after the fifth day but on or before the 30th day after my petition is filed.
