The purpose of this letter is to substantiate drainage design and concerns for the above referenced project
with the construction of nine (9) additional parking spaces. These spaces will be constructed with
pavement cross - sections, geometry and drainage patterns as illustrated on the Site Plan and its associated
detail sheet. In order to comply with the City of College Station's Drainage Policies the following issues
were analyzed and are addressed:

The grate design will require two NEENAH model R- 1878 -135G grates. These grates will have sufficient
capacity to pass the 25 -year storm at approximately 0. 10 feet of head and ponding of approximately 0. 15
feet will occur at the 100 -year rainfall event. Details of the grate inlet are illustrated on the Site Plan's
detail sheet. The existing and proposed 15" drainage pipe will pass the 25 -year storm by free -flow
conditions, but during the 100 -year rainfall event now will enter into pressure flow conditions. The flow
depth shown during the 100 -year storm reflects the pressure head at the upstream end. The proposed

Dear Bridgette:
Per my emails with Jennifer Reeves and phone conversations with Ted Mayo the staff review comments
dated October 12, 2001 are as follows:

1) See screening shrubs along both parking rows at Victoria Street (Sheet 1 of 3);
2) Additional streetscaping and canopy trees have been added along Victoria Street along the
complete length of the property. Required landscaping points have be modified appropriately;
Curbing has been added along the complete perimeter of the parking lot;
Per my phone conversations with Ted Mayo the parking lot is in the process of being bored by
CME at the four locations as shown on the Grading Plan (Sheet 2 of 3);
5) Fire lane stripping has been added on the Site Plan (Sheet 1 of 3) with special notation and the
pertinent details (Sheet 3 of 3);
*n 6) Victoria Street is a minor collector, therefore the driveway design meets ordinance;
7) The chain link fence that should be the storage area is shown on the Site Plan;
8) Please see irrigation notes. We are deferring the responsibility of an irrigation system to the
owner and for him to obtain a licensed irrigator.

Dear Mr. Marden:
This letter is to notify you that the above property is in violation of City of College Station
Zoning Regulations. A variance of 22 parking spaces was granted in March of 1997. The
variance also allowed you two years to bring the remaining 9 required parking spaces into
compliance. In January of 1999 another variance was granted extending the deadline for another
30 months from the date of that variance request. The 30 -month extension expired on July 19,
2001 of last year.
Since October 8, 2001 there have been two site plans submitted. Staff was unable to perform a
complete review due to the incomplete information provided. Staff has made several phone
contacts to Municipal Development Group however we still have not received a site plan
submittal since October 22, 2001. The subject property still has not been brought into compliance
thus; the site is in violation of Section 9 of the College Station Zoning Ordinance. Section 9.2
states:
`In all districts, for all uses, at the time any bitilding or structure is erected or enlarged or
increased in capacity, or at any tune any other use is established, there shall be provided off -
street parking spaces for inotor vehicles in accordance with the requirements specified herein. "
This correspondence is to serve you notice of the potential penalties. Failure to submit a site plan
for approval and to complete the required improvements, within thirty (30) business days of
receipt of this notification, shall constitute a violation of this section of the Zoning Ordinance. A
citation will be issued on July 15, 2002 if you fail to comply with this notice, and can result in
fines of up to $2,000 dollars per day per violation. Each day can be a separate violation.

This letter is in response to your correspondence dated June 17, 2002. As I stated in the
previous letter delivered to you May 31, 2002 (see attached), staff has received two site plans
of the subject property since October, 2001. Staff was unable to perform a technical and
complete review due to the incomplete information provided. Staff returned written
correspondence to that effect and has made several phone contacts to Municipal Development
Group. However, to date, our comments have not been addressed and a revised site plan has
not been submitted. To clarify, the following is a summary of the recent site plan activity:

It has been approximately eight (8) months since we returned comments from your last
site plan submittal and you have failed to address our comments and submit a revised
site plan.
As far as the outside storage area located on your property, I have included a copy of a 1994
aerial photograph of this site (see attached). As evident in the photograph,
the small storage
area that existed in 1994 has been expanded greatly without the necessary site plan approval
and required permits. This was referenced in our correspondence on October 12, 2001 and
again on October 24, 2001. This issue was also presented and discussed at the March 4, 1997
meeting of the Zoning Board of Adjustment in which you were in attendance.

I am responding to Ms. Reeves letter in an effort to clear up this miss before
it proceeds down a path that will be unpleasant. I have little
get treated fairly, and find the tenor of the last letter I received to be purposely
insulting.
Here are some facts to which I will stipulate:
1) October 8, 2001 MDG submitted the site plan for review.
2) October 12, 2001 Ms. George returned the comments of the staff; stating that the
staff could not complete the review due to: Submittal being incomplete, and
furthermore it was the staff's opinion that the post - annexation expansion of the
storage area trigged " Full Site Pan review ".
3) October 22, 2001 MDG again submitted the site plan, this time revised per the
previous comments received from the staff. Accompanying the submission was a
punch list letter detailing the changes made.
4) October 24, 2001 Ms. George again returned the comments; reiterating that the
review stopped because the Submittal was incomplete for the same reason stated on
October 12th; the expansion of the storage area.

I was unable to purN these matters any further other than the core samples
requested by Ted Mayo. Reason being that in the wake of September 11th business
was so bad that building fund became the survival fund. As I stated in my letter to
Ms. Reeves I am not the only business to feel the effect of that tragic event and I no
longer had the financial resources to further pursue this issue.

The Staff has erred in their refusal to completely review the plans and here is why:
The ZBA on March 4, 1997 was fully informed that the storage area in question had
been expanded after the annexation in violation of the ordinance. I did not
perform the expansion, the previous owners: Lynn and David White did. I have not
expanded the storage area since that time. spaces and
I was granted a variance which required me only to provide 9 parking ZBA minutes parking lot. (
the appropriate land�capmg and screening arch 4, 1997). The plans submitted do just that but I have not been able to get a

complete review.
I have also been told I must provide buffers and screening fences in accord with
Section 8.10 of the Zoning Ordinance, whicywas adopted on May 10, 2001, long
after I was granted my variance and extension.
In other words I have not been able to get my reviews and approvals because I do
not comply with an ordinance that was passed four years r y Was

I am in receipt of your undated certified letter regarding Ms. Reeves letter of 21
June. You make it clear that you Bread Mst Reeves letter and find t only to s be u a y
[sic] insulting." I have read and
restatement of the facts in this case.
The first point in your letter that piqued my curiosity is statement that the events of
11 September 2001 financially prevented you from complying with your variance
granted in 1997 and extended in 1999 until 19 July 2001. I trust you are aware
that the tragedies of last September r�. edate your required compliance by almost
two months. Therefore you are stating that you were not in compliance at the end
of the extension of the period granted by the Zoning Board of Adjustment (ZBA),
originally granted in March of 1997. That amounts to 64 months you have had to
comply with the terms of the variance.
My staff and I are charged with the enforcement of the City's codes and the
determinations of Boards and Commissions such and the ZBA. I am afraid that
your inability to comply with the

Greg: I have justpent the past hour with Jennifer Reeves and Natalie Ruiz reviewing this matter
The matter of the storage yard is complicated; however, even if we forgo that issue, the plans still do not
reflect the entirety of the comments that were sent out after the last two review.
This entire case is further complicated by your client inaction despite a variance with a liberal term for
compliance AND a twenty -four month extension which was again, not complied with. Staff cannot reward
your client's failure to comply by allow him permission to implement 1997 standards after he flagrantly
defied the original terms and the extension. At this point he must implement the current standards.
Concerning the storage area in particular, staff s perspective is that the use of the yard outside of the
fence can be considered an expansion in excess of 25% which could trigger full compliance for the entire
site. The yard outside of the fence is often full of pipe, concrete manholes, other such materials. The fact
that this portion of the site is utilized by a use not associated with the auto business compounds the
problem, but does not alleviate the Mr. Marden's obligations to comply.
The pipe and other materials must be placed behind the fence immediately Any future use of the yard
outside of the fence will be deemed an expansion and required full compliance for the site.
So, as it stands, we are still in need of a plan which addresses all of the last two rounds of comments,
minus the storage area (assuming the material storage is confined within the fence entirely and that this is
complied with immediately and hereafter).

Dear Mr. Marden:
This letter is to notify you that the above property is in violation of City of College Station
Zoning Regulations. A variance of 22 parking spaces was granted in March of 1997. The
variance also allowed you two years to bring the remaining 9 required parking spaces into
compliance. In January of 1999 another variance was granted extending the deadline for another
30 months from the date of that variance request. The 30 -month extension expired on July 19`" of
this year. The parking spaces have not been brought into compliance thus; the site is in violation
of Section 9 of the College Station Zoning Ordinance. Section 9.2 states:
"In all districts, for all uses, at the time any building or structure is erected or enlarged or
increased in capacity, or at any time any other use is established, there shall be provided
off - street parking spaces for motor vehicles in accordance with the requirements specified
herein. "
This correspondence is to serve you notice of the potential penalties. Failure to submit a site plan
for approval and to complete the required improvements, within forty-five (45) business days of
receipt of this notification, shall constitute a violation of this section of the Zoning Ordinance. A
citation will be issued and can result in fines of up to $2,000 dollars per day per violation. Each
day can be a separate violation.

file #01- 00500226, for review. Our conversation today included my concern that
this set of plans will meet the zoning requirements as I have been discussing them
with Ms. Jennifer Reeves. In the event time allows a brief review prior to 9 a.m.
Monday, February 24 and an oversight on my part is found, please advise me via
phone at 693 -5359 immediately so that I might repair the plans and have them
submitted by the 10 a.m. deadline.

Dear Bridgette,
Attached are ten revised site plans for Waterwood Condominiums. We submitted a
preliminary site plan in November of last year and this submittal responds to those
documents. Also included are three landscape and irrigation plans, one drainage
report, and two sets of construction documents. The site plan, development permit,
and infrastructure inspection fees in the amount of $1200.00 have previously been
