(3) The owner of Lot ONE (1) in the Subdivision shall pay an amount equal to one- half (112) of the cost of preparing and recording said replat but only up to a maximum of $500.00 to be paid by the owner of Lot ONE (1). All other costs for the replat shall be paid jointly and severely by owners of Lots TWO (2) and THREE (3) of the Subdivision. Upon recording of said replat the undersigned hereby agree than the covenants related to payment of costs set forth in this Subparagraph 3 shall be deemed satisfied without the recording of any other instrument or document. (4) The undersigned parties bind themselves to execute any agreement necessary in the future to evidence the termination of the thirty foot (30') access agreement of record if the replat to remove said easement is not recorded hereafter for any reason. (5) The undersigned agree that this agreement shall be binding upon each of them and their respective heirs, successors and assigns. Dated and executed January 25, 1999. SPECIAL PROVISIONS ADDENDUM TO LEASE BETWEEN LYNN WHITE PROPERTY MANAGEMENT, LESSOR, AND INTERNATIONAL SUPPLY OF BRYAN - COLLEGE STATION, LESSEE 1. Lessor agrees to perform the following modifications of the property prior to the commencement of this lease: i) install 340 feet of chain fence topped with barbed wire plus a 16 foot gate to enclose leased storage yard; ii) complete interior partition walls dividing the 2,500 sq. ft. lease space from the remaining 12,500 sq. ft. in the building. 2. Lessee shall not block Lessor's access through leased storage yard to Lessor's dock. 3. Lessee shall not store hazardous materials as classified by the Environmental Protection Agency on the property. 4. Lessee agrees to provide to Lessor a certificate of insurance showing that Lessee has insurance coverage for liability insurance. Lessee agrees to maintain in full force and effect during any term of this lease a policy of public liability insurance under which the Lessor and Lessee are named as insureds and under which the insurer agrees to indemnify and hold Lessor and Lessee harmless from and against any and all costs, expenses, and/or liability arising out of or based upon any and all personal injuries sustained and accidents occurring as a consequence of any act or omission on the part'of Lessee, its agents or employees. The policy shall be non- cancelable as to Lessor and Lessee's said designees, except upon thirty days written notice to Lessor. The minimum liability limits for such insurance shall be one million dollars ($1,000,000) for injury or death to any one person, one million dollars ($1,000,000) for injury or death to more than one person, and one hundred thousand ($100,000) for property damage for any one accident. 5. Lessee shall pay all taxes levied against personal property, trade fixtures and inventory placed by Lessee in, on, or about the demised premises. 6.
