In response to PLANNING Staff Review Comments dated January 2, 2003:
1. City comment is not correct. The requested information is shown on the Site Plan.
See Note #3.
2. Dimensions have been added to detail.
3. The enclosure description has been revised.
4. Fire lanes have been revised.
5. The signs have been deleted from the Table.
6. City comment is not correct. Please note that a dashed line delineating the Phase line is shown
and labeled on Sheet L 1.
7. City comment is not correct. Please note in the Comments portion of the Plant list, the trunk
diameter is shown.
8. This comment is for information only and no action is taken.
9. A note has been added to Detail 02 on Sheet L 1.
In response to ENGINEERING Staff Review Comments dated January 02, 2003:
1. This comment is not correct. The Sewer line is not shown in a Public Easement.
2. The Easement was shifted to clear the storm line.
3. Please forward your review comments of the Construction plans, submitted on
December 23, 2002.
Attached please find Two (2) copies of the revised Site plan and Landscape plan and check # 6348
for $200.00 for your use.

I do not want to set a precedent of the City maintaining any part of any private driveways. I am not willing
to ammend our maintenance agreement to accomodate this.

We are in the process of reviewing the site plan for the A &M Church of Christ. Currently, they are
proposing a landscaped median at their primary entrance on the frontage road. Their plans show the
median extending into the right -of -way (ROW) to the frontage road edge line. Catherine Hejl at TxDOT
reviewed the plans and stated that they will not allow that unless we add the median section within their
ROW to our landscape agreement. What is our stance on this?
Mike McClure would like to extend the median to the edge line to avoid having to use a series of
pavement markers to channelize traffic at the drive. He asked me what traffic control device should be
used if the median is not allowed. I told him that Dale would be able to give the best advice on that one.

Subject: A &M Church of Christ Complaint
This is in regards to the complaint call on Friday from Lynn Allen regarding a fence and some trees,
supposedly on her property, that were bulldozed down with their construction. I called the contractor on
Saturday morning and he was going to contact his sub. The site plan does show a fence on the church's
property that was shown to be removed, but it is adjacent to the caller's property at 7806 Shiloh. You may
want to send someone out their to verify that it meets the site plan. Jane told Ms. Allen that we would call
her back this morning with information. Her number is 695 -8995. If you have any questions, the
contractor's name is Phillip Devora, 281 - 932 -1606.

COVENANTS, CONDITIONS AND RESTRICTIONS

PROPERTY: Being that approximately 21.24 acre tract of land located in College Station, 9
Brazos County, Texas, more particularly described on Exhibit A attached hereto
and incorporated herein by reference (the "Restricted Property
PREAMBLE:
A. Owner is the owner of the Restricted Property.
B. Owner, in order to expedite the granting of a conditional use permit by the City of
College Station to Owner, has imposed the following restrictions on the
Restricted Property.
DECLARATION:
NOW, THEREFORE, it is hereby declared that the Restricted Property shall be held,
sold, conveyed and occupied subject to the following covenants, conditions and restrictions,
which shall run with title to the Restricted Property and which shall be binding on all parties
having any right, title, or interest in or to the Restricted Property or any part thereof, their heirs,
successors and assigns, and which shall inure to the benefit of the Raintree Neighborhood
Association, a Texas unincorporated non -profit association (the "Association ").
1. Access to Appomattox Drive. Owner's access to the Restricted Property shall
be restricted as follows:
a. Except as otherwise provided in subsection b. below, Owner shall restrict
ingress to and egress from the Restricted Property by Appomattox Drive by constructing and
maintaining a gate on the Restricted Property.
b. Owner may open the gate and allow ingress to and egress from the
Restricted Property by Appomattox Drive at any of the following times:
i. Between the hours of 6:00 a.m. C.S.T. and 10:00 p.m. C.S.T. on
Sundays;
Between the hours of 4:00 p.m. C.S.T. and 10:00 p.m. C.S.T. on
Wednesdays; and
ili. Whenever there exists a bona fide emergency requiring ingress to

and egress from the Restricted Property by Appomattox Drive.
2. Permitted Exceptions. These restrictions are made subject to any and all
matters, ordinances, restrictions, covenants, conditions, encumbrances, rights of way,
easements and all outstanding mineral and royalty interests, if any, affecting the Restricted
Property, whether or not of record in the office of the County Clerk of Brazos County. _
3, Amendment and Termination. .
a. This instrument may be amended by written instrument signed by the
Owner, and the Association. .
b. This instrument may be terminated by written instrument signed by the
Owner and the Association.
c. In the event the Association is dissolved or ceases to exist, these
restrictions shall automatically terminate.
4. Covenants Running with the Land. The provisions of this instrument will be
deemed to be covenants running with the land and binding on the Restricted Property and all
parties having any right, title or interest in and to the Restricted Property, or any part thereof.
IN WITNESS WHEREOF, owner and the Association have executed these Covenants,
Conditions and Restrictions as of the day and year first set forth above.
