Item: Presentation, discussion and possible action of a resolution,
determining a public necessity to acquire an exclusive public utility easement
interest, temporary construction easement, and temporary access easement
in certain property; giving notice of an official determination to acquire an
exclusive public utility easement interest in property for the Lift Station No.
1 Gravity Line Project (Project No. SS- 9806); and establish procedures for
the acquisition of an exclusive public utility easement interest in property.
Item Summary: In order to proceed with the planned construction of
wastewater system improvements, it is necessary that the City acquire an
exclusive public utility easement, temporary construction easement, and
temporary access easement to accommodate these improvements. The
attached resolution identifies easement interests in five (5) parcels of
property needed for the Lift Station No. 1 Gravity Line Project (Project No.
SS- 9806).
This project fulfills Vision Statement No. 1 - Core Services - We will provide
high quality customer focussed basic city services at a reasonable cost.
Item Background: The purpose of this capital improvement project is to
remove Lift Station No. 1 from service so that the wastewater flowing into it
will flow to the Lick Creek Wastewater Treatment Plant. This lift station
currently pumps wastewater from the Lick Creek Drainage Basin to the
Carters Creek Wastewater Treatment Plant. The Lick Creek Wastewater
Treatment Plant has recently been expanded to handle increased wastewater
flow. Removing this lift station will also reduce operational costs associated
with pumping wastewater.
This project is part of the Lick Creek Wastewater Treatment Plant Expansion
Project which was presented to Council on March 8, 2001.
Budgetary and Financial Summary: This project is part of the Lick Creek
Wastewater Treatment Plant Expansion which has a budget of $12,060,000.
The budget (including land acquistion) for the sewer line is $289,500. The
budget for the sewer line is $220,000 for construction and $49,500 for
engineering. Funds are available and budgeted in Sewer Revenue Bond
Funds.
Staff Recommendation: Staff recommends that Council approve the
Resolution.

Spring Creek Townhomes Subdivision, Phase 1 — College Station, Texas
Dear Ms. George:
Attached are 10 copies and the mylar original of the Revised Master Preliminary Plat for
the above - mentioned project. The plat has been revised to address the review comments
except for Engineering Comment No. 3. The 20 -foot Public Utility Easement (PUE)
along the side of Lot 39, Block 4 has not been added. The Developer has proposed an
alternate route for the proposed City sewer line that does not go through this tract.
Revisions to the Master Preliminary Plat also include the realignment of some of the lot
lines to make them perpendicular to the street right -of -way line. This was necessary due
to the construction of twnhomes rather than single structures on each lot. No right -of-
way lines were changed by this adjustment; however, right -of -way lines were adjusted
around the proposed parking areas in the cul -de -sacs. This removed the parking areas
from the right -of -way, per the Staff Comments.

Spring Creek Townhomes Subdivision - College Station, Texas
Dear Ms. George:
Attached are 4 copies of the Revised Preliminary Plat for the above - mentioned project.
Revisions include a realignment of Heath Drive so the length of Sunset Ridge Court is
within the cul -de -sac requirements. Also, a portion of the Oxburgh Drive right -of -way
was removed from this plat because it has been platted since the October 2002
submission of this preliminary plat. Other revisions address the Staff Comments dated
October 22, 2002. However, the solid waste collection issue has not been addressed with
this resubmission.

Has a 'resolution determining needs' been to Council yet on the easements for the line between the
shenandoah lift station and the 27" line? Having a copy of that resolution would be very helpful in our
easement 'negotiation'.

Will proceed as instructed.
If the question of property value presents itself, please inform Wallace Phillips, Chuck Ellison and Tim
Crowley that, in accordance with the rules, regulations, standards and laws governing condemnation
appraisal, the appraiser cannot and will not consider the property as a residential subdivision until the
final plat is approved by the City. As a result, the City will not be purchasing a residential lot out of a
proposed subdivision, but an easement across a cow pasture that has development potential.

highest priority placed on the Crowley property, since their future development will be effected by our
easement requirements.
