MY WIFE AND I LIVE AT 15 RANCHERO DRIVE, COLLEGE STATION. I'M HERE THIS EVENING AGAIN REPRESENTING THE HARVEY HILLSIDES ARCHITECTURAL CONTROL COMMITTEE. WE THANK YOU FOR THE OPPORTUNITY TO COMMENT ON THE PROPOSED REPLATTING OF LOT 42, BLOCK 1 OF THE HARVEY HILLSIDES ADDITION. I APPEARED BEFORE YOU ON SEPTEMBER 19 OF LAST YEAR WHEN YOU ADDRESSED THE ISSUE OF REZONING THIS LOT FROM A -O TO A -P. YOU SUPPORTED OUR POSITION AND DENIED THE REZONING. HOWEVER, WHEN THIS ISSUE CAME BEFORE THE CITY COUNCIL ON OCTOBER 10, THE COUNCIL OVERRULED YOUR RECOMMENDATION AND APPROVED THE REZONING. NOT A WHOLE LOT HAS CHANGED SINCE THESE EVENTS LAST YEAR - -NOR HAS OUR POSITION CHANGED ON THIS ISSUE. - HARVEY HILLSIDES IS STILL A COMMUNITY THAT IS PART IN THE COUNTY AND PART IN THE CITY. - WE HAVE COVENANTS AND RESTRICTIONS WHICH ARE STILL IN PLACE AS THEY HAVE BEEN FOR THE PAST FORTY YEARS. OUR COVENANTS STILL DO NOT AUTHORIZE COMMERCIAL DEVELOPMENT ON LOT 42. - LOT 42 IS A SALIENT INTO AN ESTABLISHED NEIGHBORHOOD AND BORDERED ON THREE SIDES BY RESIDENTIAL PROPERTIES. HOWEVER, WHAT HAS CHANGED IN THIS REGARD IS THAT THE WOODED BUFFER LOT 42 PROVIDED BETWEEN EXISTING COMMERCIAL AND RESIDENTIAL LOTS HAS BEEN DEGRADED. - ACCESS TO THE COMMERCIAL PORTION OF LOT 42 IS STILL TO BE DETERMINED. HOWEVER, WE DO BELIEVE THAT PAMELA LANE, A 16 TO 18- FOOT -WIDE COUNTRY ROAD, WITHOUT SHOULDERS OR CENTER STRIPE, WILL NOT TOLERATE ANY SIGNIFICANT INCREASE IN TRAFFIC. - AND ONE CAN ONLY SPECULATE WHAT A COMMERCIAL PARKING LOT, COPY SHOP, TRADE SCHOOL, OR CLINIC ON LOT 42 WILL DO TO THE PROPERTY VALUE OF THE RESIDENCES ON ADJOINING LOTS. FOR THE CITY TO ANNEX A COMMUNITY, THEN REZONE AND REPLAT RESIDENTIAL PORTIONS WITHOUT REGARD TO THAT COMMUNITY'S EXISTING COVENANTS SEEMS WRONG AND UNFAIR TO THE NEIGHBORHOOD AND THE COMMUNITY. CLEARLY, COMMERCIAL INTERESTS ARE TAKING PRECEDENCE OVER THE PROTECTION OF AN ESTABLISHED NEIGHBORHOOD. IN VIEW OF THE CITY COUNCIL'S DETERMINATION TO REZONE, WE DEBATED WHETHER TO EVEN APPEAR HERE THIS EVENING; WAS IT GOING TO BE JUST A WASTE OF TIME. HOWEVER, IN VIEW OF OUR FIDUCIARY RESPONSIBILITY TO UPHOLD THE PROVISIONS OF OUR COVENANTS AND RESTRICTIONS, TO IGNORE THIS REPLATTING WITHOUT COMMENT WOULD BE TO CONDONE IT - -AND THIS WE DO NOT. - AGAIN, THANK YOU FOR YOUR ATTENTION AND FOR YOUR PAST SUPPORT, AND YOUR PREVIOUS DENIAL OF THE REZONING.
