Smith Subdivision, according to plat recorded in Volume 49, Page 106 of the Deed Records of Brazos
County, Texas, and a portion of a called 0.98 acre tract as described by a Deed from Jonathan Pearce to W.
T. McDonald, recorded in Volume 109, Page 481 of the Deed Records of Brazos County, Texas. Said tract
being the same tract as described by a deed to Charles Edward Merchant recorded in Volume 566, Page
768 of the Deed Records of Brazos County, Texas.
Said tract being more particularly described by the metes and bounds as follows:
BEGINNING at a concrete nail with shiner set in asphalt pavement marking the north corner of said Lot 6
and 0.98 acre tract for reference a 1/2" iron rod found in concrete marking the north corner of a 10 foot
wide strip as described by a Deed to the City of College Station, recorded in Volume 269, Page 180 of the
Deed Records of Brazos County, Texas, bears: N 41 24' 32" E for a distance of 10,00 feet, a 1/2" iron rod
found marking the north corner of Lot 4 of said D. A. Smith Subdivision, bears: S 41° 24' 32" W for a
distance of 396.00 feet and a drill hole in concrete found on the common line of Lot 2 and Lot 3 of said D. A.
Smith Subdivision bears: (2 calls to hole) S 41° 24' 32" W for a distance of 792.00 feet and S 48 38' 10" E
for a distance of 642.22 feet;
THENCE S 48 38' 10" E along the northeast line of said Lot 6 and the southwest line of said 10 foot wide
strip for a distance of 50.00 feet to a concrete nail with shiner set in asphalt pavement marking the north
corner of Tract 1 as described by a Deed to James Byrd and Delilah Byrd, recorded in Volume 150, Page 6
of the Deed Records of Brazos County, Texas;
THENCE S 40 48' 38" W along the northwest line of said Byrd tract for a distance of 66.40 feet to a 5 18"
iron rod set on the northeast line of a called 0.25 acre tract as described by a Deed to Douglas M. Carter,
recorded in Volume 1115, Page 345 of the Official Public Records of Brazos County, Texas, for reference a
5/8" iron rod found marking the north corner of Tract 1 as described by a Deed to Shabeer Jaffar,
recorded in Volume 2438, Page 347 of the Official Public Records of Brazos County, Texas, bears: S 48
58'33" E for a distance of 193.99 feet;
THENCE N 48 58' 33" 1`i' along the northeast line of said Carter Tract for a distance of 50.69 feet to a 518"
iron rod set marking the north corner of said Carter Tract, for reference a 1 /2" iron rod found marking the
north corner of a called 0.25 acre tract as described by a Deed to Robert C. Peterson and wife, Edna R.
Peterson, recorded in Volume 308, Page 701 of the Deed Records of Brazos County, Texas, bears: S 41
33" 9i' for a distance of 82.30 feet;
THENCE N 41 24' 32" E along the northwest line of said Lot 6 for a distance of 66.70 feet to the Point of
Beginning, containing 0.0769 of an acre of land (3351 square feet) as surveyed on the ground August, 1996.
