PHYSICAL CHARACTERISTICS
Zoning and Land Use: The subject property and surrounding properties to
the north, south and east are zoned and developed
as R-1.
Subject Property: The following dimensions are approximate, please
refer to the enclosed site plan for more detail.
50' of frontage along Avenue A
74.40' northwest (side of property line)
50' west (rear property line)
74.40' southeast (side of property line)
Frontage: The subject property consists of a portion of lot 6 of
the original D.A. Smith Subdivision and Lot5, Block 4
of the unrecorded Pearce Subdivision. This gives the
property approximately 138' of frontage along Avenue
A.
Access: The lot is currently undeveloped, and would have
access via a driveway onto Avenue A.
Topography &
Vegetation: Relatively flat with no trees.
Flood Plain: Not located within a flood plain.

VARIANCE INFORMATION
Setback Required: A rear setback of 25' is required for R-1 Single
Family homes.
Setback Requested: A rear set back of 12'.
Case Overview: This case involves a subdivision that was created in
1967, which means that this subdivision is
grandfathered by right today. However, this lot does
not meet today's subdivision standards, which makes
it difficult to meet today's setback requirements and
still have enough buildable space; thus the applicant
is requesting a rear setback variance of 13 feet.
ANALYSIS
Special Conditions: The applicant states, "The primary special condition
in this case is the small size of the existing lot. Due to
physical constraints as a result of the historical
development of the neighborhood".
Hardships: As a hardship the applicant states "The 74' lot depth
makes the property very difficult to develop as
residential under current ordinance standards".
Alternatives: The applicant has stated no alternatives. The Board
has the ability to grant the variances, deny them, or
grant less than what is requested.
SPECIAL INFORMATION
Ordinance Intent: Building setback requirements usually allow for some
degree of control over population density, access to
light and air, and fire protection. These standards are
typically justified on the basis of the protection of
property values.

GENERAL VARIANCE REQUEST
This variance is necessary due to the following special conditions:
Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstances involving the
particular property. The unique circumstances must be related to a physical characteristic of the property itself, not to the
owner's personal situation. This is because regardless of ownership, the variance will run with the land.
Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lots, specimen trees.
Note: A cul-de-sac is a standard street layout in College Station. The shape of standard cul-de-sac lots are generally not
special conditions.

Hardship Definition: The inability to make reasonable use of the property in accord with the literal requirements of the
law. The hardship must be -a direct result of the special condition.
Example: A hardship of a creek bisecting a lot could be the reduction of the buildable area on the lot, when compared to
neighboring properties.
