Our said mother, Annie Pearoe, deceased, having heretofore convoyed a one saro (1)
treat out of the lands and promises above mentioned to one of us said children.,
Samuel Pearce, by deed dated the 2nd day of September, A.D. 1936, recorded in volume
11'91", page "593119 Deod Records of Brazos County, Texas, and the said Samuel Pearce,
being an heir to a child's part in the remainder of said tracts of land above mentioned,
he, the said Samuel Pearce, for the purpose of making it possible for us, the other
four heirs and brothers, to achieve a fair, equal and dust partition of said lands.and
premises among us and among him, he, the said Samuel Pearce, has this day by general
Warranty Deed reoonveyed said one acre treat to us, the said Albert Pearce, Ldward
Pearce, George Pearce, and Jonathar, Pearce so that we can partition and divide-.:among
all of the parties hereto the original six (6) acres inherited by us from our deceased

We, the said Albert Pearce, George Pearce, Edward Pearce, Samuel Pearce and Jonathan
IPearce, make this partition of the lands and promises hereinbefore mentioned by mutual
agreement, and in accordance with the wishes of our deceased mother, Annie Pearce.
The said land endpreinises mentioned herein was acquired by us. the said Albert Pearce,
George Pearce, Edward Pearce, Samuel Pearce and Jonathan Pearce, as the only surviving i
five children end heirs at law of our deceased mother, she being a widow at the time of her,
death, and we being the only children as her heirs and survivors. The said land and pre-
mises herein conveyed and partitioned was aoauired by our deceased mother, Annie Pearce,

division; and by a deed from Minnie Lee Davis, a widow, said deed being dated the 8th day
