Enclosed is my completed Zoning Board of Adjustment Application along with the $250 application fee, survey, and proposed replat drawing. I know you are very aware of my case and I appreciate the consideration you continue to put forth as we move forward. The following points I feel are important as this request is considered: ➢ I am seeking a use consistent with the current R-1 zoning! ➢ Proposed lots would comply with the R-1 zoning ordinance if not for the dedication! ➢ Proposed lots will be 29% larger than required by the R-1 ordinance! ➢ Proposed lot widths are larger than the majority of the lots in the neighborhood! ➢ Proposed replat would allow access points to move off Lincoln onto Churchill! ➢ Project approval will allow City to acquire necessary right of way and side walk construction at no cost! ➢ Six new single family homes have been constructed within 650 feet of the subject property since 2006! ➢ Four of the new homes have been constructed on lots smaller than allowed under the R-1 Zoning Ordinance! ➢ No other property along Lincoln has yet agreed to dedicate right of way as I understand! ➢ The variance allows for the maximum unit density under the current zoning ordinance! Please give me a call as you review my application with any questions or thoughts you might have. I believe this request is not only fair to me the land owner but also the City as they seek to acquire right of way, build sidewalks, seek infill redevelopment, and add to the tax rolls. Heifrin Telephone: (979) 255-3213 11580 Gold Nugget ♦ College Station, TX 77845 DATE: March 30, 2010 TO: Zoning Board of Adjustments RE: Points of Consideration for 609 Lincoln Variances Points of consideration: ➢ Use is consistent with the current R-1 zoning! ➢ Prior to City's request for the eleven (11) foot land dedication along Lincoln, proposed lots met R-1 requirements! ➢ No variance would be necessary if not for the dedication! ➢ Proposed lots will be 29% larger than required by the R-1 ordinance! ➢ Proposed replat would allow access points to move off Lincoln onto Churchill! ➢ Proposed lots will be larger than 70% the lots fronting this block of Churchill Street! ➢ There are thirteen (13) lots within 150' of the Subject Property with frontages of 45' or less! ➢ Average lot width for the block and street is 58 feet. ➢ Average lot width would be 51 feet if not skewed by three large lots. Two which face other streets and one which is currently going through the process of subdivision! ➢ Project approval will allow City to acquire requested right of way and side walk construction at no cost! ➢ Six (6) new single family homes have been constructed within 650 feet of the subject property since 2006! Three are in the permitting process on the same block! ➢ Four of the new homes have been constructed on lots smaller than allowed under the R-1 Zoning Ordinance! ➢ No other property along Lincoln has yet agreed to dedicate right of way as I understand! ➢ Rezoning the property to a higher density use such as townhome or apartment use as suggested would not be agreeable with the local residences!
