Easement Area does not have sufficient capacity to serve the anticipated use and
development of the Burdened Property.

STATION, TEXAS, and its successors and assigns, forever, and Grantor does hereby bind Grantor,
its successors and assigns, to warrant and forever defend, all and singular, these rights and
interests unto the CITY OF COLLEGE STATION, TEXAS, and its successors and assigns, against
every person whomsoever lawfully claiming, or to claim same, or any part thereof.

This conveyance shall grant the rights herein specified only as to that portion of the Burdened
Property described as the Easement Area, and any additional area outside the Easement Area (not
to exceed five (5) feet adjacent thereto) necessary to install and attach equipment necessary and
incident to the uses of the Easement Area to erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify and remove sanitary sewer lines, connecting lines,
access facilities, and related equipment upon, over, and across the Burdened Property and any
ways, streets, roads, or alleys abutting same and to cut, trim, and control the growth of trees and
other vegetation on and in the Easement Area or on adjoining property of Grantors, which might
interfere with or threaten the operation and maintenance of any public utility equipment,
accessories, or operations. Grantor shall restore the surface area of the Easement Area as nearly
as practicable to its contour and condition as existed prior to the exercise by Grantor of any rights
hereunder. It being understood and agreed that any and all equipment and facilities placed upon
said Easement Area shall remain the property of Grantee.
The easement granted herein is perpetual and non-exclusive.
Grantor shall have the full use and enjoyment of the surface area of the Easement Area but shall
refrain from any activity which unreasonably interferes with Grantee's use of the Easement Area for
the purposes provided herein. Grantor expressly subordinates all rights of surface use of the
Easement Area incident to the mineral estate to the above described uses of said surface by
Grantee.
EXCEPTIONS TO CONVEYANCE AND WARRANTY:
This conveyance is made and accepted subject to any and all matters, ordinances,
restrictions, covenants, conditions, encumbrances, rights of way, easements, tax liens,
boundary disputes, shortages in area, matters shown on surveys, maps or plats,
encroachments, overlapping of improvements, rights of parties in possession, maintenance
charges and the lien securing said charges, and all outstanding mineral and royalty interest,
if any, affecting the Burdened Property, whether or not of record in the office of the Brazos
County Clerk, to the extent, but only to the extent, the same are now in force and effect and
relate to the Burdened Property.
RESERVATIONS AND RESTRICTIONS:
Grantor desires to retain the right to tap into the sanitary sewer line for the purpose of
providing sanitary sewer service to the Burdened Property. Grantor acknowledges and
agrees that the right to use such sanitary sewer line must be approved by Grantee.
Grantee agrees not to unreasonably withhold, delay, or condition such consent.
Notwithstanding the foregoing, Grantee may restrict, limit, or withhold such consent if the
existing sanitary sewer line in the Easement Area does not have sufficient capacity to serve
the anticipated use and development of the Burdened Property.

Property and any ways, streets, roads, or alleys abutting same and to cut, trim, and control the

Grantors, which might interfere with or threaten the operation and maintenance of any public utility
equipment, accessories, or operations. Grantee shall restore the surface area of the Easement
Area as nearly as practicable to its contour and condition as existed prior to the exercise by Grantee
of any rights hereunder. It being understood and agreed that any and all equipment and facilities
placed upon said Easement Area shall remain the property of Grantee.
The easement granted herein is perpetual and non-exclusive; provided however Grantor, its
successors and assigns, or any other Grantees, by, through or under Grantor, their successors and
assigns, shall not locate any underground facilities in the Easement Area at less than 450 angle to
any of Grantee's pipelines and associated underground communication lines and provided further
such underground facilities shall be so constructed as to provide with respect to Grantee's pipelines
and associated underground communication lines and other fixtures the minimum clearances
provided by law and recognized as standard in the water industry at the time such facilities are
constructed or installed.
Grantor shall have the full use and enjoyment of the surface area of the Easement Area but shall
refrain from any activity which unreasonably interferes with Grantee's use of the Easement Area for
the purposes provided herein. Grantor expressly subordinates all rights of surface use of the
Easement Area incident to the mineral estate to the above described uses of said surface by
Grantee and agrees to procure on behalf of Grantee subordination agreements from any holder of a
superior lien on the Easement Area.

This conveyance shall grant the rights herein specified only as to that portion of the Burdened
Property described as the Easement Area, and any additional area outside the Easement Area (not
to exceed five (5) feet adjacent thereto) necessary to install and attach equipment necessary and
incident to the uses of the Easement Area to erect, construct, install, and thereafter use, operate,
inspect, repair, maintain, reconstruct, modify and remove sanitary sewer lines, connecting lines,
access facilities, communication lines, and related equipment upon, over, and across the Burdened
Property and any ways, streets, roads, or alleys abutting same and to cut, trim, and control the
growth of trees and other vegetation on and in the Easement Area or on adjoining property of
Grantors, which might interfere with or threaten the operation and maintenance of any public utility
equipment, accessories, or operations. Grantee shall restore the surface area of the Easement
Area as nearly as practicable to its contour and condition as existed prior to the exercise by Grantee
of any rights hereunder. It being understood and agreed that any and all equipment and facilities
placed upon said Easement Area shall remain the property of Grantee.
The easement granted herein is perpetual and non-exclusive; provided however Grantor, its
successors and assigns, or any other Grantees, by, through or under Grantor, their successors and
assigns, shall not locate any underground facilities in the Easement Area at less than 45° angle to
any of Grantee's pipelines and associated underground communication lines and provided further
such underground facilities shall be so constructed as to provide with respect to Grantee's pipelines
and associated underground communication lines and other fixtures the minimum clearances
provided by law and recognized as standard in the water industry at the time such facilities are
constructed or installed.
Grantor shall have the full use and enjoyment of the surface area of the Easement Area but shall
refrain from any activity which unreasonably interferes with Grantee's use of the Easement Area for
the purposes provided herein. Grantor expressly subordinates all rights of surface use of the
Easement Area incident to the mineral estate to the above described uses of said surface by
Grantee and agrees to procure on behalf of Grantee subordination agreements from any holder of a
superior lien on the Easement Area.
EXCEPTIONS TO CONVEYANCE AND WARRANTY:
This conveyance is made and accepted subject to any and all matters, ordinances,
restrictions, covenants, conditions, encumbrances, rights of way, leases, easements, tax
liens, boundary disputes, shortages in area, matters shown on surveys, maps or plats,
encroachments, overlapping of improvements, rights of parties in possession, maintenance
charges and the lien securing said charges, and all outstanding mineral and royalty interest,
if any, affecting the Burdened Property, whether or not of record in the office of the Brazos
County Clerk, to the extent, but only to the extent, the same are now in force and effect and
relate to the Burdened Property.
RESERVATIONS AND RESTRICTIONS:
Grantor desires to retain the right to tap into the sanitary sewer line for the purpose of
providing sanitary sewer service to the Burdened Property; provided that Grantor shall
comply with the requirements of the City of College Station Code of Ordinances, such
compliance being determined solely by Grantee. Grantor acknowledges and agrees that the
right to use such sanitary sewer line must be approved by Grantee. Grantee agrees not to
unreasonably withhold, delay, or condition such consent. Notwithstanding the foregoing,

Grantee may restrict, limit, or withhold such consent if the existing sanitary sewer line in the
Easement Area does not have sufficient capacity to serve the anticipated use and
development of the Burdened Property.

STATION, TEXAS, and its successors and assigns, forever, and Grantor does hereby bind Grantor,
its successors and assigns, to warrant and forever defend, all and singular, these rights and

PROPERTY:
All that certain tract or parcel of land containing 0.3407 acres of land, more or
less, lying and being a part of Lot JA, Replat of Lot 1 Agency Records Control,
Inc, an addition to the City of College Station according to the plat recorded in
Volume 4872, Page 158, of the Official Records of Brazos County, Texas, said
03407 acre tract being mom particularly described by metes and bounds
description on Exhibit "A" attached hereto for all intents and purposes,
provided, however, that this conveyance shall grant the rights herein specified only as to that
portion of the above-described property more particularly described on the attached Exhibit "A"
known as the "easement area," to install and attach equipment, guy wires, and anchor; necessary
and incident to the uses of the Easement Area to erect, construct, install, and thereafter use,
operate, inspect, repair, maintain, reconstruct, modify and remove the following:
Electric transmission and distribution lines;
Water lines and sanitary sewer lines, connecting lines,
access facilities, and related equipment;
Storm sewers and collection facilities;
Television, telephone, and communications lines;
Drainage ditches, drainage pipes and all other drainage
structures, surface and subsurface;

upon, over, and across the said PROPERTY as described and any ways, streets, roads, or alleys
abutting same, and to cut, trim, and control the growth of trees and other vegetation on and in the
easement area which might interfere with or threaten the operation and maintenance of any
public utility equipment, accessories, or operations. It being understood and agreed that any and
all equipment and facilities placed upon said PROPERTY shall remain the property of
GRANTEE.
GRANTOR expressly subordinates all rights of surface use incident to the mineral estate to the
above described uses of said surface by GRANTEE, and agrees to lender's subordinations on
behalf of GRANTEE. GRANTOR will provide GRANTEE with the names and addresses of all
lenders.
GRANTOR shall have the right to use, occupy and enjoy the surface and air space above the
easement area for any purpose which does not interfere or threaten the safe, proper or convenient
use, occupancy or enjoyment of same by GRANTEE; except that GRANTOR shall not construct,
place or permit any buildings, fences or other like structures or improvements in, under, through,
upon, over, or across the easement area, or cause or permit any change in grade of the easement
area once any of the facilities of the GRANTEE are installed, without first obtaining the written
approval of GRANTEE.
RESERVATIONS AND RESTRICTIONS: None
TO HAVE AND TO HOLD, the rights and interests herein described unto the CITY OF
COLLEGE STATION, TEXAS, and its successors and assigns, forever, and GRANTOR does
hereby bind himself, his heirs, executors and administrators, to warrant and forever defend, all
and singular, these rights and interests unto the CITY OF COLLEGE STATION, TEXAS, and its
successors and assigns, against every person whomsoever lawfully claiming, or to claim same, or
any part thereof.
