1. There are special circumstances or conditions affecting the land involved such that strict application of the
subdivision regulations will deprive the applicant of the reasonable use of his land.
2. The waiver is necessary for the preservation and enjoyment of a substantial property right of the applicant.

3. The granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other
property in the area, or to the City in administering subdivision regulations.
4. The granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in
accordance with the provisions of the Unified Development Ordinance.
Fee in lieu of sidewalk construction is being requested because of the following condition (if applicable):
F_ An alternative pedestrian way or multi-use path has been or will be provided outside the right-of-way;
r The presence of unique or unusual topographic, vegetative, or other natural conditions exist so that strict
adherence to the sidewalk requirements of the UDO is not physically feasible or is not in keeping with the purposes
and goals of the LIDO or the City's comprehensive Plan;
F A capital improvement project is imminent that will include construction of the required sidewalk. Imminent shall
mean the project is funded or projected to commence within twelve (12) months;
F The proposed development is within an older residential subdivision meeting the criteria in Platting and Replatting
within Older Residential Subdivisions Section of the UDO; or
r The proposed development contains frontage on a Freeway / Expressway as designated by Map 6.6, Thoroughfare
Plan - Functional Classification, in the City's Comprehensive Plan.
